Where and how can construction be carried out between Moosstrasse and Gartenstrasse in the west of Weilheim?

- The Weilheim city council's building committee recently discussed how no building should be carried out in this mature residential area.

The committee unanimously rejected massive new construction plans for the corner of Eichtweide and Gartenstrasse: The fact that the developer wants to build two apartment buildings with a total of eight residential units plus garages with “duplex parking” on two adjacent properties is “madness,” as they said (we reported).

However, the district office sees no legal reason for rejection and threatened to simply replace the municipal agreement on the two building applications.

The city, in turn, does not want to allow planning sovereignty to be taken away from it.

That's why it is now drawing up a development plan for the district and is also issuing a change ban to secure the planning.

BfW city council had eleven critical questions about the plan

Before the city council decided on the matter at its most recent meeting, Manfred Stork explained the reason again.

In the construction project mentioned, everything would be “too narrow.

He therefore recommended that the development in this area - i.e. between Sommerstrasse, Gartenstrasse, Frühlingstrasse and Moosstrasse - be "allocated into an orderly urban development path" using a development plan to steer".

City council member Florian Lechner (BfW) sent a list of eleven critical questions to the town hall before the meeting.

For example, he wanted to know whether affected owners would have to expect restrictions on building options without a development plan.

Stork replied that the land-use planning should enable “a certain amount of densification”, “but in an orderly manner”.

“The development plan does not prevent, it orders,” emphasized 2nd Mayor Angelika Flock (CSU) as chair of the meeting.

But in this way “maximum excesses” could be slowed down.

And in the opinion of most council members, that is necessary.

“The city has to take action here,” said Green Party spokesman Manuel NEUENNER – because how the construction project in question “is supposed to fit into the surrounding area is a mystery to me.”

Brigitte Holeczek assured that the development plan does not want to “curtail anyone”: “On the contrary,” said the BfW parliamentary group leader to the unsettled landowners: “One or two more building options will probably emerge.” But it is about an overall “tolerable one “Re-compaction”.

But the building applicant did not respond to this.

Honisch is annoyed by the fact that a development plan process is now necessary “due to a lack of insight from an individual” – especially in light of the fact that “there is always a demand for a reduction in bureaucracy”.

FDP city councilor criticizes the city's actions

In contrast, Saika Gebauer (FDP) “did not agree” with the city’s approach, especially with the blocking of changes.

She shares the district office's view that the construction project in question fits in.

Ultimately, this is measured “by the cubature, not by the number of residential units”.

And the prescribed distances were adhered to, albeit barely.

“We need living space,” added Gebauer, “and someone is creating living space here – we won’t see that as often in the near future.”

The majority of the council nevertheless decided what the building committee had already proposed: the existing building applications for two apartment buildings with a total of eight apartments on the properties at Eichtweide 2 and Gartenstrasse 17 were rejected.

And the preparation of a simple development plan for “Gartenstrasse / Moosstrasse” including the issuance of a change ban was approved.

The scope of this development plan includes 56 properties.

There were dissenting voices to all of this from Gebauer and Lechner.
