A former cardiologist from the Noyal-Pontivy hospital (Morbihan) has been on trial since Tuesday on appeal before the Loire-Atlantique Assize Court for the rape of a patient and sexual assault by a person abusing the authority conferred by its functions. Daniel M'Bey, 63, was sentenced at first instance to 15 years of criminal imprisonment by the Morbihan Assize Court on February 7, 2023, as well as a permanent ban on practicing a medical or paramedical profession.

A patient, aged 21 at the time, accuses him of having raped her during a consultation in October 2018, in the liberal practice that he had opened a few months earlier in parallel with his activities at the Pontivy hospital. The doctor allegedly injected him with a fast-acting sedative and hypnotic product (midazolam). The victim then had a

“black hole”

during which Daniel M'Bey allegedly had sexual intercourse with her. Scientific analyzes confirmed the presence of male DNA compatible with that of the doctor on the young woman's clothes and the presence of midazolam, in very small quantities, in her blood.

Another patient, aged 24 at the time of the events, then denounced a sexual assault, which occurred during a consultation at Pontivy hospital in 2017, after an injection

“to thin the blood”

according to the doctor. A third patient, who had also been his secretary after classes when she was a high school student, finally reported a sexual assault in her office. She was only 18 years old then. Several patients interviewed by investigators also reported inappropriate words or

“big pervert”

attitudes during consultations, when he had, for example, called one of them a

“miss world”

or offered another an invitation. at the restaurant on a prescription.

The accused, born in Congo and father of six children, refutes all the facts with which he is accused and evokes a

“consensual”

relationship with the patient accusing him of rape.
