A construction worker stole from the supermarket. Not only the stolen goods, but also a pocket knife become his downfall.

– Shoplifting is not worth it. This was the experience of a construction worker from Geretsried who was caught smuggling two deodorants and two Käsekrainer past the checkout in a supermarket with a total value of 16.97 euros without paying. Because the police who were called found not only the stolen goods but also a pocket knife in his backpack, the 49-year-old now had to answer for theft with weapons before the Wolfratshausen district court. The penalty for this: 3600 euros.

“I didn’t intend to steal it,” the defendant said.

He was tired when he quickly went to the supermarket after work on September 19 last year “to buy tobacco.” The defendant said he still knew that he had put the sausage in his backpack, “but I had no intention of stealing it.” He didn't take a shopping cart with him "because I was in a hurry," said the accused, who stated that he had duly paid for tobacco for 5.30 euros at the checkout. And he didn't use the knife to steal, he always had it in his pocket for his snack. “I use it to open canned goods and spread on bread.”

“If someone has a weapon with them when they steal, that is sufficient to constitute a criminal offence,” explained Judge Helmut Berger to Geretsried. The fact that the legislature has set a punishment range of six months to ten years shows that this is not a trivial offense. However, like the public prosecutor's office, the court viewed the matter as a less serious case with a lower penalty range and sentenced the construction worker to 120 daily rates of 30 euros each, a total of 3,600 euros.

The convicted person can pay off the amount in installments of 200 euros. The defendant accepted the verdict.
