A woman became ill after a corona vaccination and had to be put into a coma. Now she is suing the manufacturer Astrazenca.

Bamberg - A woman from Upper Franconia falls seriously ill after a corona vaccination. She is demanding compensation and compensation from the manufacturer Astrazeneca - and has now achieved her first partial success.

On Monday, April 8th, a civil chamber of the Bamberg Higher Regional Court (OLG) sentenced the company to provide comprehensive information about side effects of its corona vaccine “Vaxzevria”. This was announced by a court spokesman. The civil case is among the first against a corona vaccine manufacturer in Germany. The company must therefore provide data on all known effects and side effects of the vaccine as well as any other information that may be important for assessing the acceptability of harmful effects of the vaccine, “insofar as these include thrombosis with thrombocytopenia syndrome (TTS ) regarding". 

The information must be provided for the period from December 27, 2020 - the approval of the vaccine - to February 19, 2024. The Senate did not allow an appeal against the decision.

Intestinal vein thrombosis after Astrazeneca vaccination - woman put in coma

The 33-year-old was vaccinated with the Astrazeneca corona vaccine in March 2021 and then suffered a so-called intestinal vein thrombosis. She then fell into a coma and ultimately had to have part of her intestines removed. The plaintiff is now demanding compensation and damages. In the course of the proceedings, the now successful lawsuit for information was added.

He and his client are very happy about the court's decision, said the woman's lawyer, Völker Löscher. He assumes that this success will be followed by further claims for information in similar proceedings. The data now to be made available by Astrazeneca could be relevant for other ongoing and future procedures, said Loeschner. Basically, Astrazenenca has to make the data available immediately. But he wanted to give the company a deadline of several weeks, said Loeschner. 

The court spokesman pointed out that the information to be provided only related to the plaintiff's illness. Data provided by Astrazeneca is initially only accessible to the parties to the lawsuit. In her lawsuit, the 33-year-old also requested information from Astrazeneca about all interactions with the vaccine. But the Senate rejected this. He did not allow an appeal against the partial verdict. The company may still be able to lodge a non-admission complaint against the decision with the Federal Court of Justice in order to obtain an appeal. 

Woman demands compensation for damages and pain and suffering from Astrazeneca

The plaintiff's compensation and pain and suffering proceedings are continuing. The woman is demanding at least 250,000 euros in compensation from Astrazeneca, as well as 17,200 euros for loss of earnings and up to 600,000 euros for future impairments. Astrazeneca's lawyers have so far ruled out a settlement with the plaintiff and referred to the decision of the Hof Regional Court.

The court dismissed the woman's lawsuit in the first instance because it could not identify a product defect or an information error in connection with the vaccine. The woman appealed against this. A spokeswoman for Astrazeneca had previously said: “Our condolences go out to those who have reported health problems.” Patient safety has the highest priority. In addition, the regulatory authorities have strict standards to ensure the safe use of all medicines, including vaccines. “Medicinal authorities around the world have confirmed that the benefits of vaccination with our Covid-19 vaccine Vaxzevria outweigh the risks of extremely rare potential side effects.”
