A witness in the dock instead of the defendant: Behind a strange scene at the Ebersberg district court lies a depressing story from an asylum accommodation that will probably have consequences.

- The hearing at the Ebersberg district court began strangely: a man with a letter of summons in his hand entered the courtroom and sat down on the chair where the defendant usually sits.

Judge Benjamin Lenhart quickly noticed that the wrong person was sitting there. With the help of an interpreter, it became clear that the Arabic-speaking man was the possible victim of an assault in an asylum center in the northern district. The defendant himself, who also lives in the accommodation, was missing. He is a younger man who is said to have had several run-ins with the law. The man could not be reached by phone and the hearing had to be postponed.

Judge Lenhart took the opportunity to question the witness. There was hardly any discussion about the exact course of the alleged assault. However, the witness claimed that there were constant conflicts. The background is that the defendant provided false information to the German authorities. This also applies to three of the man's friends, whom the witness described as "security men". And there were new allegations: the day before the court date, he was threatened by the defendant, according to the witness. "He screamed. “He didn’t want me to come to the hearing,” the man explained through the interpreter. “He wanted to hit me in the face.” The witness filed a police report.

The prosecutor's ears pricked up. She applied for an arrest warrant against the defendant. A new court date has been set for the end of May. Judge Lenhart was worried about the witness. “It is not acceptable for you to be beaten and threatened there.” The judge advised that the man should contact the police immediately in such cases in the future.
