The bad news continues: Due to legal proceedings, there is now a risk that the renovation of the Olchinger high school will be further delayed
Olching – “Everyone involved will be protected. “Not us,” complained District Administrator Thomas Karmasin in the district council. He explained the recent developments in the planned renovation of the high school, although in the background there is always the problem that the ongoing legal proceedings are not actually public and therefore every word must be carefully weighed.
Karmasin reminded once again that the district administration wants to deny the contract to the cheapest bidder in the tender for dismantling work. The background is bad experiences with the company in question, with which another legal dispute is ongoing.
The case is now before the state supreme court
According to Tagblatt-Info, there is also a suspicion of a shortfall in supply. The company in question had filed an investigation with the government of Upper Bavaria because the contract was not awarded, said Karmasin. The district won this procedure with the awarding authority.
“If you think we can move on now, you’re far from it,” said Karmasin. The company in question filed an appeal, so the case is now before the Bavarian Supreme Court. The question is currently being examined there. Until this inspection is completed, the district is not allowed to entrust any other company with the work.
Time is of the essence. If a decision is not made within three weeks, everything will be delayed by a year, said Karmasin. Particularly bitter: the costs for the containers in which lessons take place during the renovation of the existing building continue. The containers cost 300,000 euros a month, said Karmasin. “We need a decision within three weeks. Otherwise we will lose a year and 3.6 million euros,” said Karmasin.
Existing building currently not usable
When asked by Olching's mayor and SPD district councilor Andreas Magg, it became clear that the impending delay was due to the planned move back during the summer holidays and due to the sequence of various trades. In response to Magg's request, a spokeswoman for the building administration also explained that use of the existing building would no longer be possible in the event of a one-year delay due to fire protection. It also became clear that the operating costs of the containers were higher than those in the existing building. Because the containers are heated electrically.
Comparison?
Rolf Ertel (AfD) asked whether a settlement could be concluded with the company. His logic: If the order that the company is missing out on is less financially significant than the three million euros, that could make sense. Karmasin pointed out that he was not allowed to name the amount of the offers. The thought expressed is not far off. In fact, according to Tagblatt information, the idea had already been discussed in the background, but was rejected again because otherwise it would open itself up to blackmail.
The mayor of Gröbenzell and UBV district councilor Martin Schäfer recalled the debate a few years ago about whether it would be better to buy the containers for storage. In view of the current developments, a purchase would have proven to be the right thing to do, said Schäfer. This was rejected at the time because of the costs, but also because of the question of what should be done with the 600 (!) containers after the renovation.
There was already a delay
There was an initial delay in the renovation because a structural engineer criticized the containers. This problem has been solved. The classrooms have been in the containers since the Christmas holidays. The move was actually planned for summer 2023.
Another problem at the construction site: The costs, which were initially estimated at around 40 million euros, are currently over 80 million euros.
