Investigations for Financial Fair Play: Manchester City fails with complaint before the Cas

Manchester City is threatened with the exclusion from the Champions League for violations of the Financial Fair Play. To prevent that, the club turned to the Cas. But he does not see himself responsible.

Manchester City has failed in front of the International Court of Justice Cas with a complaint about investigations by the European Football Association Uefa. "The Cas has decided that the appointment of the football club Manchester City is inadmissible," said Cas Secretary General Matthieu Reeb.

The Uefa has determined against the English champion for violations of financial fair play. The association's financial control authority issued an official recommendation to the adjudicatory board. According to the "New York Times" and the news agency AP, the one-year exclusion of the club from the Champions League was demanded. To date, the Uefa but has not passed a judgment.

City had questioned the validity of the investigation results and complained to the sports court. The allegations of financial irregularities are completely wrong, it had been ignored in the investigation, a comprehensive collection of irrefutable evidence, the club said at the time. The complaint Manchester did not give the Cas but now instead.

This is how the Cas justifies its decision

According to the Sports Court, "the complainant must have exhausted the remedies available to him before the appeal". Since the transfer of the case of the financial control authority to the judicial chamber of the Uefa and a recommendation of a sanction is not yet a final decision, this can not be challenged before the Cas, it said in a statement.

In another case involving transfers of underage gamblers, Manchester City was fined approximately € 340,000 by the Disciplinary Committee of the World Football Federation Fifa in August.

The investigations of the Uefa had been started after the Football Leaks revelations of SPIEGEL. Internal e-mails and club documents, which are available Football Leaks, to show how City systematically circumvented the rules. So alleged sponsorship funds from Abu Dhabi are in fact paid by club owner Mansour bin Zayed Al Nahyan.
