Deportivo accuses LaLiga of having paid 15% of the television rights corresponding to the season that is about to start, which could incur a crime of unfair administration. The Galician club, affected by the Fuenlabrada case, presented this Friday morning in the Higher Sports Council a document with an extensive list of what it considers additional offenses that adds to those already mentioned two weeks ago to request the disqualification of Javier Tebas , president of LaLiga, and to which Numancia joined then.

The new offenses that Deportivo exposes are detailed in six points. In the first place, the Galician club warns about those advance payments to the clubs in terms of television rights. "It is an irregular performance and abuse of authority," emphasizes Deportivo, who recalls that the 2019-2020 season has not yet ended and it is not known in detail which clubs will participate in the different categories. "Not only is it against the law but could lead to unfair administration behavior," says the Galician club, which identifies these payments as a LaLiga strategy to achieve maximum support for the refusal to expand the Second Division to 24 teams. Deportivo asks that the CSD urgently request Tebas to justify the criteria adopted to make these payments.

Thus, the Galician club warns of a series of irregularities that would require the immediate intervention of the institution chaired by Irene Lozano, which is silent after issuing a harsh statement against LaLiga and Fuenlabrada on July 22 for breaching the security protocol and committing a "Serious mistake" when allowing the Madrid team to travel to A Coruña to play against Deportivo. "They put the health of their players, public health and the competition as a whole at serious risk," the CSD then censured. Days later, the federal judge's instruction essentially picked up that impression and, in application of the disciplinary code, asked the Competition Committee for the descent of Fuenlabrada, on which it must decide now.

In this new letter sent to the CSD, Deportivo demands the immediate initiation of a disciplinary proceeding in Tebas for very serious infractions and irregularities provided for in article 76 of the Sports Law. And, “given the seriousness of the events” he requests the “very urgent” adoption of the precautionary suspension of Tebas as president of LaLiga, according to articles 10 and 43 of the same Law. “His actions over the last few weeks are seriously affecting the Spanish professional football competition and generating an image of an unprofessionalized industry by continually adopting self-interested and arbitrary decisions ”, explains the Galician club in the letter signed by its president Fernando Vidal, which adds that Tebas is putting Tebas in serious danger the integrity of the competition, as well as the health and safety of both footballers and fans.

The plan of the Higher Sports Council, according to a consulted spokesperson, is to take notes and await events. “We have nothing to say, at least, until the Competition Committee makes a decision and communicates it to us. Then we will see what the different parties ask us ”, they point out. Competition has an open submission period until the end of the coming week, so its determination is not expected until September.

On the other hand, Deportivo that Tebas points out a favorable and partial treatment towards Fuenlabrada and cites a news item from L'Equipe that ensures that the president of LaLiga maintained a commercial link with the Madrid club until two years ago by which Billed him 130,000 euros for legal advice. In addition, it warns that the expert report cited by LaLiga to show that the orders of the investigating judge are presumably issued by the deputy secretary general of the Spanish Football Federation, was requested and paid for by the football association: "Money from the different clubs that make up LaLiga to help a single team in a cause in which more clubs are involved, such as Numancia, Deportivo and Elche ”.

EL PAÍS has had access to the expert report in which coincidences are described between texts by the deputy federal secretary Miguel García Caba and the instructor Ricardo Esteban Díaz. Several of them correspond to headings of regulations or royal decrees. There are also coincidences in turns of expressions such as "however, not only ..."; "All of it"; "From all this it is inferred"; "in conclusion"; "with personality"; "On the other hand" or "in no case". The coincidence of these expressions in the texts of one and the other serves, according to experts, to help identify that they are from the same person. Also the use, in both cases, of identical phrases such as "the correct development of sporting events"; "Risks for spectators or participants". A source close to federal authorities, consulted by this newspaper, qualifies these conclusions as "a joke." "These are references to laws or expressions in use in the world of law," they emphasize.

The catalog of irregularities that Deportivo exposes to the CSD also includes a list of publications on Twitter, already deleted, by the Fuenlabrada doctor, Juan Manuel Blanco. It also alludes to the conclusions of the dismissal order of the Investigating Court on the detention of Álex Bergantiños and exposes the “unacceptable insults and disqualifications that the president of Fuenlabrada repeatedly carries out to directors of the Federation and Sports, with the complicit silence of The league". “They have generated a scene of circus and anger in the world of Spanish professional football that is giving a regrettable image at national and international level both of the football industry and of the problem-solving capacity of the political leaders who supervise its operation ”, explains Deportivo to the CSD.
