Third division Türkgücü Munich does not give up in the cup dispute with the Bavarian Football Association (BFV).
The club rejects the arbitration tribunal's judgment and announces further legal action.
Managing director Max Kothny spoke to several media outlets of a "Mickey Mouse court" and emphasized that his club could "not accept the arbitration award like that".
The arbitral tribunal had decided on Tuesday in the sense of the BFV that not Türkgücü, but regional league Schweinfurt 05 should play in the first round of the DFB Cup against Schalke 04.
The game is scheduled for next Tuesday (November 3rd, 4.30 p.m. / Sky) in Gelsenkirchen.
The negotiation took place in the boardroom of a hotel, and also behind closed doors, Kothny reported in the sports buzzer and complained: "That says it all."
The functionary spoke of a "sad day for the judiciary" and called the verdict "so not admissible".
His reason: "There is a serious antitrust error."
Kothny therefore announced: "We will not sit on us and have the case examined by the Federal Court of Justice."
No appeal has yet been lodged with the Federal Court of Justice.
As a spokeswoman confirmed to SPIEGEL, the responsible Senate of the Federal Court of Justice would first have to decide whether there is any jurisdiction at all.
It is also unclear whether the case can be resolved by next week.
Usually the Bavarian amateur champions - i.e. regional league winners - take part in the first round of the cup.
Because the league had been interrupted due to Corona, the officials worked out a compromise in the spring: The table leader at the time of the lockdown, Türkgücü, should move up to the 3rd division.
The Schweinfurters in second place got the right to start the cup.
On Tuesday evening, the BFV was relieved by the arbitration award, whose jurisdiction had previously been confirmed by the civil senate of the Bavarian Supreme Court.
"The week-long legal drama is finally over," said President Rainer Koch: "And now we're going to do it with Franz Beckenbauer: Go out and play football."
At Türkgücü, those responsible see it differently.
