Before addressing the CJEU, Ruiz de Lara had already issued an order in Spain in which he requested precautionary measures against any attempt by UEFA to paralyze the Super League or to sanction the 12 founding clubs.

The nine clubs that reneged on the Super League, six English (Manchester City, United, Liverpool, Chelsea, Arsenal and Tottenham), two Italians (Milan and Inter) and one Spanish (Atlético de Madrid) will also be in the hype after their resignation to participate in the elite competition.

These clubs have also recently been readmitted to the European Club Association (ECA).

The intention of UEFA was to apply a strong hand immediately against the three clubs that persist in the idea of ​​organizing a closed competition with the great European teams. According to documents dated May 25 pertaining to the disciplinary file that UEFA opened to Real Madrid and to which EL PAÍS has had access, the sanction proposed by the two instructors is to punish the white club with the aforementioned two years without playing in Europe, one million euros and 20% of their income for participating in the Champions League during the two years after serving the punishment. The instructors base their sanctioning proposal on the violation of UEFA statutes 2 and 51.1 and articles 4, 5 and 6 of the Champions League regulations, all based on admission rights and the integrity of the competition.The document also states that a repentance would lower the sanctions.

That UEFA had a clear intention to penalize Real Madrid, Barcelona and Juventus is revealed by the choice of instructors.

One of them, the Swiss Jean Leuba, is a classic in the disciplinary proceedings undertaken in recent years by the European body against Spanish clubs.

The sanctioning process initiated by UEFA has been stranded waiting for the CJEU to rule, once the Luxembourg-based court rejected the request for urgent procedure requested by Ruiz de Lara.

Both UEFA and FIFA have until October to present allegations and the resolution is expected by summer 2022 at the earliest.

The path taken by the Spanish judge is similar to that used in 1995 by the Belgian judge in the Bosman case, which ended up establishing the free movement of footballers in the member countries of the European Union.

If the CJEU agrees with the shortlist of clubs, a panorama would open that would change the structures of European and world football, once the clubs would start to manage the exploitation rights of the international tournaments in which they participated.

This was the intention of the big European clubs and they were negotiating with UEFA the creation of a 50% -owned joint venture, as well as the study of a new Champions League format that was far from the one that was finally approved from 2024.

The new format

The new European Cup will raise the participants from 32 to 36 teams and these will no longer play in the group stage twice against three rivals (home and away), but instead will face 10 different teams, playing five home games and another five at home. The eight with the most points will qualify directly for the round of 16 and those occupying positions from nine to 24 will play a preliminary tie. The semifinals will be a single match at the same venue as the final. The approval of this format by the ECA, although it was signed by the 12 Super League clubs, and its subsequent ratification by the UEFA Executive Committee, triggered the announcement of the creation of the disruptive competition and the subsequent battle that condemned Real Madrid,Barcelona and Juventus to not be included in the drums of this afternoon's draw.

The war continues, but for now this Champions League will have the entirety of the clubs that earned the right to participate in it.
