Footballer Yitzhak Aspa, who ran over the late Ari Nesher boy and was convicted, among other things, of abandoning him, will receive early release, after the prosecutor's office announced tonight (Thursday) that he will appeal to the Supreme Court against the release committee's decision this week.

The Northern District Attorney's Office made the decision "in the absence of a legal ground for such a petition and despite the great severity that the prosecution sees in the actions of Aspa. Notice was given to the parents of the late Nesher." With his vehicle.

According to the announcement, "The decision of the Parole Board was carefully examined by the Northern District Attorney's Office. After hearing the position of the late Ari Nesher's parents and after consulting with the central body on this issue in the State Attorney's Office, the District Attorney decided that the committee's decision could not be appealed."

It will be recalled that Aspa, who played for MS Ashdod, was not accused of causing the accident itself because he could not prevent it from happening.

He was prosecuted for a number of offenses but at the end of the day was convicted only of abandonment after injury and obstruction of justice, and sentenced to 4.5 years in prison.

The Supreme Court, which heard Aspah's appeal, noted that although these were "particularly serious and ugly" offenses and the legislature aggravated the punishment for the offense of abandonment, the sentence imposed on Aspah substantially exceeded the customary sentence. The Supreme Court reduced his sentence to three years' imprisonment. And determined that the aggravation of punishment should be done in a measured and considered manner.

The Parole Board adjourned in October the hearing on Aspa's request for early release, to allow him to complete the treatment process.

The committee has now decided that it meets the conditions set out in the law for early release - it is worthy of release and the danger posed to it for public safety has diminished.

The prosecution's conclusion that there is no legal basis to appeal to the court against the release committee's decision was based, among other things, on the Prisoner Rehabilitation Authority's recommendation to release him so as not to interrupt the treatment sequence he received in prison; The late Nesher;

And even accepted responsibility for the boy's death, even though the accident was inevitable for him, and he was not prosecuted and in any case was not convicted of causing the death of the late Ari.
