The 44-year-old sportsman, who appeared before the Reims judicial court (Marne), was prosecuted for "driving under the influence of an alcoholic state", "contempt of a person holding public authority", "conduct of 'a motor vehicle during the retention of the driver's license' and 'putting a vehicle into circulation despite the immobilization prescribed by a police officer'.
On October 22, while traveling between Reims and Épernay, Yohann Diniz was subjected to a blood alcohol test in Champfleury which turned out to be positive, with a rate greater than 0.80 grams per liter of blood.
Then brought to the gendarmerie brigade of Taissy, he is accused of having insulted three gendarmes.
The contempt was “particularly contemptuous”, noted the judge.
Authorized to leave the gendarmerie the next day, the athlete had resumed driving, despite the obligation to immobilize his vehicle and the retention of his driving license.
Accompanied by his lawyer, Me Nicolas Hübsch, he did not make a statement after his appearance to plead guilty.
The three-time European champion was also sentenced to a three-month driving license suspension, a fine of 135 euros and to pay 150 euros in damages to each of the three outraged gendarmes.
