"Gagging scandal": allegations unfounded - sports court restarts the game and acquits the player

The alleged strangle attack by a youth player from Kirchheimer SC on a referee has caused waves in recent weeks.
Now there is a verdict.

The verdict in the alleged "strangle scandal" from Murnau is here.
As a reminder: The U17 top game in the district league between TSV Murnau and Kirchheimer SC was canceled in the 56th minute.
The reason for this: After the Kirchheim coach sent Hüseyin Sözer off with yellow-red, there was no adult to look after the team.
However, this is prescribed for youth games in the BFV statutes.
The referee was therefore forced to stop the game.
As a result, there were ugly scenes in which the Kirchheim players besieged the referee and one of the players allegedly choked the referee.
TSV Murnau against Kirchheimer SC: Judgment after the game was abandoned
Kirchheim vehemently denied the strangle allegation afterwards.
Especially the Sözer and the alleged strangler saw themselves exposed to enormous hostilities.
The hearing before the sports court took place last Wednesday, December 7th.
The verdict was handed down on Friday 9 December.
Kirchheimer SC announced these results on Wednesday: In a press release, KSC stated that the game would be replayed, the coach had been fined for unsportsmanlike conduct and the player accused of choking had been acquitted.

But how did the verdict come about?
The game is replayed because the referee's decision to stop the game was illegal.
According to JO § 50 (2), Sözer should have continued to work as a coach despite the yellow-red card.
Furthermore, the sports court classified the trainer's behavior "at the lower end of the unsportsmanlike scale".
According to the verdict, there were no insults or fisticuffs on the part of the coach.
Last but not least, there are the allegations of strangulation against the player: In the verdict, the young person is acquitted "because he was demonstrably completely uninvolved away from the action."
Kirchheimer SC: Video leads to sports court verdict
Kirchhheimer SC benefited from the fact that a player's father filmed what happened after the demolition.
After the game, the referee and a referee who was present claimed that the coach had insulted the young referee in different languages and that he had been choked by a player.
The video, which is available on site, apparently exonerated coaches and players.

When asked about the BFV, the latter said: Allegations must be 100 percent proven.
If this is not the case, the presumption of innocence applies in the sense of the accused.
Kirchheimer SC: Sözer relieved by the verdict
Sözer and his player are particularly relieved by the verdict.
"Those weren't easy times.
It was very difficult to deal with all the hateful comments, some of which were racist.
The time was really extreme, especially for my player.
I wouldn't wish that on anyone," says Sözer.
The KSC coach is now just happy that the allegations have been refuted.
"I would like to thank the BFV for the fact that the negotiation was extremely fair.
My club, Kirchheimer SC, also gave me and my player great support during this time.
I am extremely grateful for that.
I hope this issue is closed now and maybe some people will apologize to us.
That wasn't right," says an audibly relieved Sözer.
Klemens Wind, referee chairman of the Weilheim group, did not want to comment on the verdict when asked by Fußball Vorort/FuPa Oberbayern.
