Rescue alleys on motorways are tempting for motorcyclists, but can they just drive through?

  • The new traffic regulations of the StVO amendment contain a stricter catalog of fines.
  • Among other things, driving through emergency lanes is now punished more severely.
  • But does that also apply to motorcyclists?

The new traffic regulations of the StVO amendment * have been in effect since April 28. In general, violations are now punished with higher penalties. For example, driving on emergency lanes is now punished more severely. Motorists who drive on the cleared lanes must not only face a fine, but also a withdrawal of their license. But is the same for motorcyclists?

These rules apply to motorcyclists in emergency lanes

Drivers must expect higher penalties and driver license withdrawal *, especially if they exceed the speed limit. But even when driving illegally onto rescue  alleys, there is a fine of 240 euros. It does not matter whether rescue workers are disabled or not.

The same thing actually blooms for motorcyclists . The Frankfurt traffic lawyer Uwe Lenhart explains to Autobild that the rules apply equally here. Depending on the degree of disability, danger or even property damage, motorcyclists can also face a fine of up to 320 euros.

In addition, strictly speaking, the passage through the rescue alley violates the prohibition of overtaking right . Even if many drivers tolerate this - because they probably just don't know better - motorcyclists would have to be punished for this. In addition, there is usually a fine of up to 100 euros and a one-month driving ban. "However, successful reports against motorcyclists are very rare because identification is difficult," says Lenhart.

Are there no exceptions for motorcyclists?

The demand for the clearing of emergency lanes for motorcyclists  has arisen more often. However, the risk is too great that motorists will also be tempted. "That would also completely undermine the acceptance of escape routes," explains Lenhart.

The motorcyclists are not only interested in avoiding the waiting time in a traffic jam. Instead, especially in good weather, there is a risk that they will collapse in the thick motorcycle gear .

Motorcyclists are actually allowed to overtake standing cars in the left lane. However, this is not possible in reality because there is not enough space between the vehicles and the guardrail. In addition, motorists could be endangered by the passing motorcycles. Therefore, motorcyclists have no choice but to park the vehicle on the hard shoulder and wait until the traffic jam clears.
