A forty-something was sentenced Tuesday by the Assize Court of Meurthe-et-Moselle to 18 years of criminal imprisonment for "murder" after having killed with 82 stab wounds his mistress who, according to him, harassed him because she refused that he leaves her, according to a judicial source. The jurors did not follow the requisitions of the attorney general Philippe Renzi: this one had asked for a sentence which is not less than 20 years of imprisonment.
At the hearing as during the investigation, David Bousch, 46, admitted the murder but denied the premeditation.
For one of the civil parties, Me Alain Behr acknowledged that the absence of premeditation had emerged from the debates of the Assize Court.
On January 9, 2018 in Laxou, near Nancy, after a sexual relationship which was to be the last, the accused sent his partner an SMS in which he said to her about his mistress: "My love, I only see that" a solution, I'm going to plant it, I'll end up in jail, too bad ”.
Immediately, she replied: "No, don't do that".
But he had ignored it and returned: "I love you never forget it but I will never be able to live in peace again".
According to David Bousch, the murder was committed after a last sexual encounter which he had accepted because his mistress, aged 43, had promised to leave him alone afterwards.
But according to him she changed her mind and threatened to attack her relatives.
It was in his eyes the word too many, which had made him crack and start kicking with a knife he owned.
