McDonald's employee in Le Havre sacked after reporting sexual harassment

An employee of a McDonald's in Le Havre (Seine-Maritime), who denounced acts of sexual harassment and assault, before being dismissed, will seize the industrial tribunal.

Mathilde, 21, claims to have been the victim of sexual harassment from an employee, now a staff representative.

"He told me

when I spent in the kitchen, asked questions about my sex life ...", she says.

The young woman complains to the deputy director and the harassment stops.

When other employees complain in turn in 2019, he is laid off for eight days, but, according to Mathilde, "his behavior does not stop".

A manager of the same restaurant, since dismissed, is also accused of harassment and sexual touching.

On October 24, the young woman went on strike with fifteen other colleagues to protest against these actions.

A “like” on Facebook and a private conversation on Messenger

When questioned, the management of the restaurant, who recalled their "determination to fight against all forms of harassment", indicated that they had launched an internal investigation which "confirmed a certain number of behaviors relating to sexual harassment" and that "disciplinary procedures have been initiated. immediately engaged ”.

"A dismissal has already been pronounced and a second procedure is awaiting authorization by the labor inspectorate," she explains in a statement.

Mathilde receives on December 19 a letter of dismissal without notice and without compensation for "serious misconduct".

In this letter consulted by AFP, the manager reproaches him for having expressed his agreement by "liking", by liking, on Facebook the comment of an Internet user who said "step 2, burn your hierarchy", then "like" took of.

He also accuses him of having declared, during a private conversation on Messenger, a Facebook messenger, that the deputy store manager was "racist, homophobic, sexist".

"Such actions are totally contrary to the company's values ​​of mutual respect."

According to management, this dismissal is "unrelated to the events of October 24" and "was carried out in accordance with labor law, following serious acts of repeated insults towards managers and incitement to violence on workers. social networks ”.

According to Loïc Roldan, general secretary CGT / fast food restaurant, a dozen employees say they are victims of harassment and sexual assault in the establishment.

"It is dramatic to see that it is the whistleblower who was fired and that McDonald's flies employees in their private conversations," he denounces.
