Will you one day be convicted of “fraudulent presentation of a health pass belonging to others”? A circular that will be sent this Monday by the Ministry of Justice to all jurisdictions advocates such a new incrimination, we told the Parisian, confirming information from the JDD. Thus, a person who does not have a health pass but who uses that of a relative would be liable to a 4th class fine of 750 euros (fixed at 135 euros if it is paid quickly). In the event of a repeat offense within 15 days, the amount rises to 1,500 euros. It will be 3,750 euros and six months in prison if the person commits the same mischief for the third time in thirty days.
The law promulgated on Thursday already provided for a new legal framework, and the purpose of this circular is to "ensure that the prosecutors are well informed of new offenses and of the reading recommended by the ministry", indicates the entourage of the Keeper of the Seals , Eric Dupond-Moretti.
These fines are also included in the press kit sent by Matignon this Sunday noon.
Fraudulent caregivers
The circular says it wants to build a “criminal, effective, dissuasive and rapid response” to such acts.
Government spokesman Gabriel Attal announced a first week of “running in” for the expansion of the health pass from Monday, but especially for professionals.
It is therefore not certain that the magistrates will show flexibility over the next few days.
