Cédric Jubillar always proclaims his innocence and his lawyers are working to get him out of prison.

More than two months after his indictment for the murder of his wife Delphine Jubillar and his incarceration in the Seysses (Haute-Garonne) remand center, Jean-Baptiste Alary, Emmanuelle Franck and Alexandre Martin are preparing to testify a new appeal against his remand in custody.

This will be done this Wednesday, August 25, as confirmed to us by Me Emmanuelle Franck.

The first appeal, filed on June 23, was not successful since the investigative chamber of the Toulouse Court of Appeal had decided, in a judgment delivered on July 8, to keep Cédric Jubillar in detention. , considering that serious or concordant clues actually weighed against him.

But his lawyers also noted that material elements presented as being dependent by the prosecution were not mentioned in the judgment of the investigating chamber or so attenuated.

Material elements deserve to be deepened

"The idea according to which Louis, the son of Cédric and Delphine, would have heard a violent argument the evening of the disappearance of his mother is contradicted by the chamber of instruction, exposes Me Franck. In addition, the judges of the investigating chamber also considered that other material elements deserved to be deepened and verified. It is in particular question of the schedule to which two neighbors tell to have heard "strident cries" which could come from the residence of Jubillar, traces of condensation noted in the car of Delphine on December 16 in the morning, supposed to testify, according to the prosecution, of a human presence at night, or even of the direction of parking of the vehicle which would have changed during the night.

In this context and to continue to influence the progress of the investigation, the defense of Cédric Jubillar considers that it is opportune to re-apply for release. The outcome of this appeal will not be known for several weeks. Without waiting for this deadline, the husband's lawyers are now trying to obtain an improvement in his conditions of detention. Since June 18, Cédric Jubillar has been placed in solitary confinement. A decision taken by the prison administration, particularly in view of the high media coverage of the case and the risks it could run in contact with other prisoners.
