Filing a complaint is an everyday act, often necessary even for common justifications, when official documents are lost or for insurance reimbursement requests.

Reforming the procedure is therefore a small revolution.

Was it already possible to file a complaint online?

At the moment, it is not possible to lodge a complaint online as such. But a first step towards this dematerialization was taken in 2012. After a successful experiment in the Hauts-de-Seine and in the 15th arrondissement of Paris, the government decided to generalize the online pre-complaint. Thus, since 2013, it is possible to prepare your complaint on a dedicated site. In 2020, 925,000 pre-complaints were filed, according to the Ministry of the Interior. This is 60% more than in 2019, in particular because of the confinement.

The online pre-complaint allows you to find out your identity and the circumstances of the facts for which you are filing a complaint even before obtaining an appointment.

Enough to reduce the wait at the police station and shorten the interview with the "complainant".

But this device only concerns damage to property (theft or fraud) or certain discriminatory acts by an unknown author.

And it is still necessary to travel to collect the facts and sign the complaint.

What will the online complaint look like?

Emmanuel Macron has not delivered any details on the aspect or the complaints that will be dematerialized. Asked by the Parisian, the Ministry of the Interior has unveiled some leads. It will not be the same tool as the online pre-complaint. This one "no longer meets in 2021 the criteria of modernity and expected use", explains the Interior.

For the moment, only "certain thefts, the deliberate degradation of vehicles, the theft of unregistered two-wheelers, graffiti, burglaries and the fraudulent use of means of payment" seem concerned.

Beyond saving time, Emmanuel Macron's announcement broadens the possibilities given to citizens to file a complaint.

Are the unions in favor?

According to article 15-3 of the Code of Criminal Procedure, police officers and gendarmes are required to receive all complaints from the taxpayer which could correspond to an offense falling under the Criminal Code. They must then send them to the prosecutor. It is only the latter who decides whether the case should lead to prosecution.

This process is time consuming and frustrating for some agents, as a large portion of filings will not result in an investigation. Thus, for the unions, the measure has potential: "An automation of the filing of complaints could lighten the work of the agents and improve their working conditions", rejoices Yann Bastiere, national delegate of the union SGP Police FO. "Tools based on algorithms can help the police and the gendarme in decision-making", indicates the Ministry of the Interior.

The deputy national secretary of the independent union of commissioners, Mathieu Vallet also sees it as a way of improving the service provided: “Why not, if that makes it possible to better orient and facilitate upstream procedures.
