The Toulouse-Lautrec family, who demanded the return of the castle where the painter grew up, in Aveyron, was dismissed on Wednesday by the Rodez criminal court, which released the current owners.

During the hearing, on June 2, the prosecutor requested an 18-month suspended prison sentence against the spouses Corinne and Jean-Claude Putzola, accused of "swindle" and "abuse of weakness and trust. ".

For the prosecutor, the current owners of the castle would have taken advantage of the vulnerability of Nicole Tapié de Celeyran, great-grand-niece of the painter, before her death in 2016. The old lady was "blinded by the Putzola couple, they abused her ignorance in legal matters, ”he denounced at the time.

Because four months before his death, the painter's heiress had designated Jean-Claude Putzola and his wife Corinne as the sole universal legatees of the castle.

A "very disappointing" decision

For his part, Jean-Claude Putzola said Wednesday that the court decision "is the victory of an old lady who has fought all her life against her family".

"It is an unfortunate story of succession where ousted heirs react badly and see the evil where perhaps he is not", said for his part the lawyer of the current owners of the castle, Me Elian Gaudy, saying " expect ”that the prosecution, which had not yet spoken, to appeal.

On behalf of the civil parties, Me François Rastoul described the decision as "very disappointing".

Fifteen descendants of Toulouse-Lautrec and of Nicole Tapié de Celeyran had become civil party in this affair, notably asking for ownership of the 12th century estate.

The Toulouse-Lautrec museum in Albi was also a civil party.

A transfer of 20,000 euros

The facts go back to the summer of 2015. That year, the painter's great-grand-niece, Nicole Tapié de Celeyran, met the Putzola spouses, through a cousin by marriage.

Aged 90, the old lady lives in the residence of Bosc, in Camjac in Aveyron.

But quickly Jean-Claude and Corinne Putzola moved into the private apartments of the castle.

A few weeks later, in October, they appear in a will of the nonagenarian, alongside other "natural" heirs.

Three other wills will follow, until the last, in April 2016 - four months before the death of the heiress - where only the name of Putzola appears.

Before her death, Nicole Tapié from Celeyran had also transferred a sum of 20,000 euros to their account.

Classified as a historical monument, the castle of Bosc located in the town of Camjac and "estimated at more than a million euros" according to Me Rastoul. It was in this 12th century residence and this 22 hectare park that Henri de Toulouse-Lautrec spent part of his childhood. The artist, who died in 1901, is still present there through a set of children's drawings, personal objects, posters and photographs, notes France 3 Occitanie.
