Also on Yom Kippur, the masses of Beit Yisrael are expected to pedal out on the empty roads from cars, which ostensibly makes them seemingly "sterile riding cabins" and safe.

But in practice, according to data from the Green Light Association, no less than 230 people have been frightened every Yom Kippur in recent years to hospitals due to involvement in road accidents.

In quite a few cases, the accidents that occur do not end with the evacuation of the victim to the hospital, but also reach the court, since quite a bit of money is involved in the story.

In fact, the court is required to decide which of the parties is responsible for the accident and how the monetary compensation will be divided among those involved.

In order to make an order and understand who is responsible for compensating who in the event of an accident on Yom Kippur, we asked Adv. Assaf Warsaw, co-chair of the Torts Forum and co-chair of the Bar Forum at the Bar Association and one of Israel's senior insurance lawyers to do for us Order and answer the key questions that arise.

A 10-year-old electric bike rider burst onto the road and as a result I flew off the electric bike I was riding. Who is responsible for the accident?

Liability for an accident will be determined according to the degree of deviation of the parties from the language of the traffic regulations. Keep in mind that like any other day, traffic laws apply in exactly the same way and therefore, crossing a road that is not a crosswalk, driving in the opposite direction of traffic, right of way, etc. is a violation of the law. In addition to this, since this is a day when there is a lot of traffic of riders alongside masses of children who move around freely, there is an increased duty of care on the users on the road to anticipate that some factor may break into the road or deviate from its path. Thus, in such a case, the court may determine that the liability rests with the parties almost equally, again, subject to the particular circumstances of the accident.

What is the law in a case where a mechanical bicycle rider is injured as a result of being involved in an accident with an electric bicycle?

In 2020, a groundbreaking ruling was handed down by the Supreme Court that ruled that electric bicycles do not constitute a motor vehicle and therefore also have no insurance obligation.

In such a case, the law that will bind the parties is the tort ordinance that imposes a liability on the users of the road.

Ordinary cyclist Anne pedestrian will be required to prove that the rider violated the duty of care and caused the accident through his negligence.

And so for example, if it turns out that the rider was riding at high speed in a crowded terrain cabin, where there is a lively movement of children, the court may determine the electric bike rider is the main cause of the accident.

In Yom Kippur, without cars and on empty roads. Am I expected to stand and wait for the traffic light to turn green before crossing the intersection?

Yes, just like that. Although the police do not enforce the law and turn a blind eye to disobedience to it, this does not mean that it does not exist and applies just as it does on any other day of the year. Thus, crossing an intersection at a red light and causing an accident as a result, is likely to cause the violator of the law to pay compensation to the injured party. Furthermore, the more the police are involved, the greater the chances that, in addition, an indictment will be filed against the offender.

I was injured while riding an electric bike in an accident defined as self-harm? Who will compensate me?

In such a case, there are a number of factors that can be contacted: First of all, as long as there is personal accident insurance or loss of ability to work - the insurance company is the address to contact.

Also, in the case of a school student, a claim can be filed under a student policy.

In addition, insofar as it turns out that this is an accident that occurred due to a road accident - it is very possible and possible to sue the local authority.

How do I know if the authority should compensate me for the damage done to me?

Both the Torts Ordinance and various municipal bylaws impose an obligation on the local authority to maintain the public areas in its territory including the road, while maintaining a sufficient level of service that it provides to its residents. The question of the authority's liability in the event of damage and the degree of negligence attributed to it, depends on a number of factors, including the manner in which the pit or hazard is formed. In the case of a pit that was opened on the road due to preventive or ongoing maintenance that was not carried out correctly, it is not inconceivable that the court will determine that this is negligence on the part of the authority. Alongside that, not every bump or crack in the road will be considered a hazard. Courts have repeatedly ruled that city streets and sidewalks are not a 'sterile surface' and should not be treated as a place without cracks, bumps and 'waves' of slopes, one way or another. This or that thing can be treated as a hazard on the road when it comes to a significant disturbance for which the authority was responsible for the regulation, and it was proven that there was no sign, sign or marking that there was a disturbance,And the rider was careful enough and yet could not detect the disturbance in a timely manner. Reality shows that in many cases the court determines a broken open sewer on the road, without any sign or sign warning of its existence, and especially if the municipality is aware of its very existence - will be considered a hazard. It should be remembered that when the victim does not prove that the pit in the road was deep or significant enough, but a small 'depression' in the road - the court tends to determine that it is not a hazard. Thus, the injured party has a documentation obligation if he wishes to receive compensation for his damages.

The Ten Commandments for Yom Kippur Safe on a bicycle

Erez Kita, CEO of the Green Light Association (Photo: Official website, Green Light Association)

Most road accidents on Yom Kippur are bicycle accidents without the involvement of another road user. Children and teenagers do not follow the rules of caution, fall and break limbs or are injured in the head.

Therefore, before riding, it is important to check the health and safety of bicycles, electric bikes, scooters, skates or skateboards and most importantly - do not ride without a helmet.

What is important to check?

1. Tire integrity - air, tears, cuts.

2. Brake integrity - front and rear.

3. It is important to check the condition of the headlights, and the reflectors for riding when it gets dark.

4. Reflectors not only on the bike but also on the body.

5. It is mandatory to wear a helmet. It saves lives.

6. It is highly recommended to wear additional safety accessories, such as elbow and knee pads as well as gloves.

7. Make sure that the child fits the height of the bike and that the feet or at least the tips of the toes touch the ground.

8. If the child is not proficient enough to fit in a lot of traffic around, found a riding area that would endanger the

10. Electric bicycle - not ingredients child over the age of eight and Indeed, then only with a suitable seat

Erez Kita, CEO of the Green Ar Association: "Yom Kippur is a day that is often hit by children in bicycle accidents or other two-wheeled vehicles.

Many people tend to mistakenly think that this is a safe day to ride a bike but the reality is completely different due to the large number of riders and the feeling of security.

Many riders are injured in self-accidents or in accidents with other riders or with vehicles traveling on the road.

In recent years, electric bicycles and scooters have also entered our lives, reaching high speeds, and the severity of the injury has increased accordingly.

"It is very important for the precautionary rules, especially to ride with a helmet and shields, to get through Yom Kippur in peace."
