It is a rare decision.

Justice recognized at the end of October the link between the suicide of a nurse and her working conditions at the Le Havre Hospital Group (GHH), in Seine-Maritime.

A nurse in the neonatal medicine department of Le Havre hospital, Emmanuelle, 44, ended her life on June 24, 2016. She had left a letter to her husband in which she denounced her difficult working conditions.

The administrative investigation and the work of a joint committee had demonstrated, a year later, "the direct and unique link" between his suicide and his conditions of service.

On October 26, according to Actu.fr, the responsibility of the GHH was recognized in first instance by the administrative court.

"Feeling of guilt for having made a mistake"

Emmanuelle's suicide had aroused turmoil within the hospital and a psychological unit had been set up. After a reorganization within the pediatric services of the hospital, the caregiver had asked not to return to the service and to undergo training to reorient herself. Despite management's promise, she had not received any offers.

Ten days before her fatal act, the nurse was arrested after taking care of an infant that had gone wrong.

She took her own life the day before she returned to work.

"His suicide results from the feeling of guilt for having made an error in the care in intensive care of an infant", indicates the court, according to the information site, which ensures that the judges considered the hospital center "guilty of a breach of his obligation of security and protection towards the deceased ”.

The GHH was ordered to pay 360,000 euros in compensation to Emmanuelle's companion and their two children.

According to the plaintiff's lawyer, on Monday, the hospital had not sought to appeal the decision.
