The channel of the new right blog »Axis des Guten« around the journalist Hendryk M. Broder has to be restored from YouTube, at least for the time being.

"T-online" reported on a corresponding preliminary injunction on Tuesday.

The video platform deleted the “AchGut Pogo” channel with 113,000 subscribers shortly before Christmas because it violated community standards three times within 90 days.

The operators took action at the Karlsruhe Regional Court.

Her lawyer, Joachim Steinhöfel, argued, among other things, that YouTube rated a video that it had previously checked and activated itself as a third violation and thus used it as the reason to block it.

The clip with the title "Das Staatsvirus" was available for 14 days in the spring of last year and has disappeared since May 27, 2021.

YouTube had blocked the video because of "medical misinformation."

On December 16, it was reactivated because a new check did not reveal any violations of the community guidelines.

On December 22nd, YouTube criticized this video again - and blocked the channel.

A YouTube spokesman said "t-online" that the company does not comment on ongoing proceedings.

Steinhöfel criticized that YouTube ignored the case law of the Federal Court of Justice with his approach.

In the case of Facebook last July, he decided that platform operators may delete posts and block users if their posts violate in-house guidelines.

But those affected must be informed before the threat of deletion and given the opportunity to explain themselves.

The channel is not yet on YouTube again: According to Steinhöfel, this could take four to six weeks: “The injunction must now be served in Ireland.

Until then, the legally forbidden breach of law will continue «.
