While a dismissal was confirmed in favor of Luc Besson in France at the end of May, the Belgian-Dutch actress Sand Van Roy, who accuses him of rape, filed a complaint in a Belgian court against the filmmaker and producer, said a judicial source on Tuesday, confirming information from Belgian media.
Sand Van Roy filed a rape complaint for the first time on May 18, 2018, a few hours after a meeting in a Parisian palace.
According to her, the influential filmmaker, now 63, had imposed on her digital anal penetration, a source of fainting, despite her orders to stop.
The Court of Cassation has yet to rule in France
A version of the facts accredited by an anal fissure noted on the day of the facts by the medico-judicial emergencies, but which was not enough to convince justice.
The latter considering in a judgment that it could not establish “the absence of consent” of the complainant.
Luc Besson him, regretted an extramarital relationship in a context of "subordination", while the actress had shot in some of his films.
But he indicated twice that he had "no memory" of an anal intercourse and recounted a consented vaginal intercourse imbued with "sweetness".
In parallel with the procedure in France, where the Court of Cassation will now have to rule, Sand Van Roy has instructed a Belgian lawyer to bring the case to Belgian justice.
A complaint for "rape" was filed in April before the court of Bruges (north-west), this lawyer, Joris Van Cauter, told AFP on Tuesday.
Information confirmed by the public prosecutor's office of the Flemish city.
"A diversion", according to Besson's lawyer
The complaint was filed "before the dismissal" returned on appeal in Paris, "we believe that the investigation in France was not a real investigation, we did not do what must be done", supported Me Van Cauter, refusing to go into detail.
With Le Parisien, Sand Van Roy had however repeatedly questioned the conclusions of the magistrates responsible for investigating his case.

At the Bruges court, an investigating judge was seized of the investigation, and a closed-door hearing is scheduled for September before the council chamber (an investigating court) to decide on the follow-up to be given, said a spokesperson for the prosecution joined by AFP.
Luc Besson has not yet been heard by the judge, according to this same source.
Thierry Marembert, the director's Parisian lawyer, on Tuesday described the referral to a Belgian judge as a "diversionary operation" by the opposing party.
Since the start of the case four years ago, "seven different French magistrates, judges and prosecutors, all women, have examined these charges and all considered that Luc Besson was innocent and that the criminal investigation had been thorough" , said the lawyer.
