For thousands of drivers in Israel who drive without mandatory insurance, this is a net profit of thousands of shekels over the years, for those affected by them, this can be the beginning of an absolute nightmare.

It could be someone standing behind you at a traffic light, or the one who just turned without signaling, the one who didn't stop for pedestrians - if you are involved in a car accident with a driver who is not insured with mandatory insurance - you are not only in a medical problem.



For such cases, the State of Israel has "Karnit", a fund for victims of road accidents designed to ensure receiving compensation for bodily injuries when there is no insurance company to compensate him.

On the face of it, the process should be simple - compensation to the victim from the fund and its continued dealings with the offending driver.

More than two years after an accident in which a 17-year-old was injured by a vehicle that was not insured with mandatory insurance, he is still waiting for the compensation he claimed through attorney Little Beaver-Haikin Makarnit and through her from the offending driver. In the accident, which was recorded on the security camera at the scene, the boy was seen walking on a narrow street, without sidewalks and dimly lit Halki, when a speeding commercial car hits him.



The MDA team that arrived at the scene following a call from passers-by evacuated him to the "Meir" hospital in Kfar Saba where he was diagnosed with a significant head injury and was sedated and ventilated.

From there, the boy underwent a long hospitalization process in the surgical department during which he complained of pain, dizziness, vomiting, instability, weakness, falls and blurred vision.

Even today, after more than two years from the day of the accident, he is still under medical follow-up, under tests, treatments and needs psychiatric drugs and painkillers.

Due to the hospitalization, the rehabilitation process and the symptoms he has suffered since then, the boy finished his studies with a partial matriculation and was unable to continue working at his job as a warehouseman or persevere in other jobs he tried.

Today he is employed as a driver in a construction company, but even there he needed many breaks.



The amount submitted in the lawsuit that is currently pending in the Magistrate's Court in Tel Aviv-Yafo is up to NIS 2.5 million, this is the maximum amount that can be submitted in the Magistrate's Court in this type of lawsuit.

As mentioned, if and when the court awards compensation to the victim, will Karnit sue the offending driver, regarding the chances that the full amount will return to her and actually to us (the fund is financed from the provisions of the compulsory insurance of all other drivers)?

In a ruling of the District Court from May of this year, a driver whose car was not insured, was driven by someone else and was involved in a car accident was required to pay only NIS 50,000 to Carnet.
