But why is the technology built in at all?

There is probably no car manufacturer that is as controversial as Tesla.

While the fan community primarily praises the supposed technological advantage of their brand, many others primarily see a major safety risk in the electric car manufacturer.

Above all, the "autopilot" system in its various stages of development often appears in the negative headlines.

Recently, Tesla was even sued in California for misleading advertising - because a range of functions is promised that cannot be kept.

The so-called "guard mode" of the Stromer is also celebrated by many brand fans.

But the almost constant camera surveillance is actually illegal in Germany under data protection law.

But why is the technology installed in the vehicles at all?

While other manufacturers test for a long time with professional staff in order to get a technology safely on the road, Tesla usually takes a different approach: For example, beta versions of the "Full Self-Driving" software are tested on public roads - consumer advocates have been warning since for a long time that the Tesla drivers were used as “test engineers” so to speak.

The so-called "sentry mode" is also highly controversial in this country: When it is activated, eight cameras record the surroundings in the vehicles almost non-stop - with a range of 250 meters and a 360-degree all-round view.

The problem here, however, is not safety in traffic - but the issue of data protection.

Tesla: "Guardian mode" has already caused alarm bells to ring among authorities

Not long ago, the topic of "guard mode" had already caused the alarm bells to ring at police authorities - because officials also privately drive Tesla vehicles and move about with the numerous cameras on company premises.

However, the general question arises: Is the use of Sentry technology legal in Germany?

According to a report by the TV program “Auto Mobil” (VOX), definitely not.

In the TV report, a representative of the Berlin data protection authority (BlnBDI) explains that the "guard mode" is illegal under data protection law if it records uninvolved third parties in public space who know nothing about it: "The guard mode cannot be used in public space in accordance with the law be used.” The technology represents a violation of data protection in the public sphere – in other words: it is basically illegal.

By the way, the Federal Consumer Association (vzbv) sees it the same way and has sued Tesla for this reason, among other things.

Because theoretically everyone who is being filmed would have to give their consent.

However, the technology of the “guard mode” may be installed – the Federal Motor Transport Authority (KBA) reveals the reason for this when asked by “Auto Mobil”: In Europe, the manufacturers therefore have the choice in which member state they have their product approved – and Tesla got its type approval in the Netherlands.

Apparently there were no objections to the technology there.
