Refusal to comply in Rennes: no prosecution against the police officer after the death of a 22-year-old woman

The public prosecutor of Rennes announced on Wednesday the closing without further action of the procedure opened against a police officer after the shooting death of a young woman of 22 years during an anti-drug operation, on September 7 in Rennes.

The investigations led "to the closing without follow-up by the prosecution of the procedure for intentional violence having led to death without the intention of giving it by a person holding public authority (…) which had been entrusted to the IGPN in order to “analyze the circumstances of the shooting of the Nantes BRI police officer” at the origin of this death, details the press release from prosecutor Philippe Astruc.

According to the investigation, his physical integrity having been "threatened", "the shooting of the policeman seemed to be able to fall within the specific legal framework of the use of weapons recognized for the police by article L 435-1 1° of the code of internal security (…) and respect the prescriptions in terms of absolute necessity and strict proportionality”, specifies the magistrate.

Another judicial investigation in progress

In addition, the prosecutor announced the opening of a judicial investigation on September 30 against the driver of the Peugeot that the police were trying to intercept during the operation and whose young woman killed was a passenger.

This judicial investigation is open in particular for "attempted murder of a person holding public authority, aggravated manslaughter" and "refusal to comply".

During this anti-drug operation, which took place around one o'clock in the morning, the driver of the Peugeot, known to the police, allegedly refused to comply and drove towards a police officer, who had opened fire.

The driver was injured in the arm and his passenger, hit by a ricochet, died shortly afterwards.

The family of the victim, unknown to the judicial services, "who had filed a complaint for manslaughter in the context of the two procedures mentioned, was received by the public prosecutor of Rennes and informed, as well as his counsel, of the direction of these two procedures,” the statement concludes.
