This amazing reasoning belongs to Judge Leah Schlesinger Shamai of the Central Traffic Court, who refused to return the driver's car that was confiscated by the police, after his wife drove it even though she never issued an


Audi Etzion license.


An urgent medical examination is not grounds for driving without a license, and may end up with the car being confiscated for a month.

This is even when the driving was done without the permission of the vehicle owner.


On January 6, a police officer in one of the central cities stopped C, a driver who was driving a family Kia Sid against the direction of traffic.

The driver claimed that she has had a driver's license for three years, but a check at the police terminal revealed that she had never issued a driver's license.

The policeman confiscated the vehicle for 30 days.


G's husband, T., appealed to the Central Traffic Court through lawyers Liron Oron and lawyer Ron Ben Shabbat from Merd Ilon Oron, demanding to cancel the prohibition order and return the vehicle to him.


According to him, he urgently needs the car for work needs, and to drive his wife, who is pregnant at risk, to medical examinations.


The police prosecutor claimed, after interrogating T., that the husband had contributory responsibility for the incident, that he did not keep the car keys, after explaining that he carried one key to the car, and that the spare key was left in one of the drawers in their bedroom.


Judge Leah Schlesinger Shamai determined that there is no reason to make it easy for T, because of the dangerousness of the offense of driving without a license committed by his wife, and because he "admitted in his investigation that he did not make it clear to his wife that she was not allowed to use the car, and did not keep the keys from his wife."


T. appealed to the district court in Lod through an attorney from the Ilon Oron firm. Judge Amit Michals wondered why T. should have suspected his wife of driving a car without a license, given the fact that it was the first time she had done so. The judge reversed the decision and determined that the car would be returned to the couple 18 days after being taken.
