In Bremen, cars parked on sidewalks annoy residents and pedestrians.

Now a court has decided that the authorities must not accept that.

Update from December 25, 2022, 8:05 a.m .:

The Bremen traffic authority must not accept wild parking on the sidewalks, but must enforce the road traffic regulations.

This was decided by the Bremen Higher Administrative Court after a complaint by residents.

This is reported by several media in the Hanseatic city.

In practice, this means that the responsible public order office must take action against those who park illegally, for example by issuing warnings or even having the tow truck approach.

The residents have already won against the inactive authority in the second instance.

However, they can still appeal to the Federal Administrative Court.

If the verdict stands, it could have an impact on other cities with a similar situation.

First report from December 14, 2022, 2:24 p.m.:

When residents and drivers have to arrange themselves in narrow neighborhoods, there is often enough trouble programmed.

Especially when it comes to parking (which includes long-term caravan parking) and both groups overlap.

There is currently a heated argument in Bremen.

In the Findorff district, many cars sometimes park on sidewalks because the streets are apparently too narrow for correct parking.

Residents keep asking the city administration to take action against this wild parking – but they hardly intervene and have come to terms with the situation, as

reports.

Wrong parkers: Residents in Bremen are suing for more parking tickets

As a result of blocked sidewalks, passers-by and cycling children have to move onto the roadway.

In order to change that, several residents sued the responsible traffic authority - and were right in the first instance.

The public order office responsible for parking tickets must therefore be forced to enforce the road traffic regulations.

But the authorities appealed.

It is now up to the Higher Administrative Court.

If the verdict is confirmed, it would not only have an impact on the Hanseatic city of Bremen, but possibly also on other communities: Residents there could then feel encouraged to complain.

Illegal parkers: There is no customary law for violations of the law

Basically, the wind is currently shifting towards pedestrians.

There is even an app that you can use to report illegal parkers or to take photos of them.

Parking on sidewalks in particular is widespread, and drivers often invoke an alleged customary right”.

However, there is no such thing for violations of the law: If you drive through a red light three times without being caught, you will still be punished for the fourth red light violation if you are flashed at it.
