2023-01-04T16:23:27.575Z

This decision comes after the death at the end of 2018 in the Lariboisière emergency room of a 55-year-old patient, found dead abandoned on a stretcher.

Structural lack of means, individual errors... The Paris prosecutor's office requests a trial for manslaughter against the Assistance Publique-Hôpitaux de Paris (AP-HP), after the death at the end of 2018 in the emergency room of Lariboisière of a patient aged 55. years old, found dead abandoned on a stretcher.

On December 22, the day on which the Minister of Health François Braun spoke of a "

critical " situation and "

saturated

" emergency services

, a magistrate from the Paris prosecutor's office asked in an indictment, consulted by AFP, the referral to corrections from the AP-HP for the death of Micheline Myrtil, "

which occurred in a context of characterized lack of medical and nursing supervision, in a service for which it was known that the premises and the nursing staff were insufficient in relation to the needs

".

Long hours in the waiting room

If this succession of dysfunctions did not directly cause the death of the patient, it did not prevent the death and contributed to it

”, affirms the public ministry.

Suffering from headaches and calf pain, Micheline Myrtil, born in Martinique in 1963, was dropped off at the Lariboisière emergency room by the firefighters on December 17, 2018 at the end of the afternoon, then received and directed to a waiting room. .

According to the magistrate, she then spent "

five hours without any support

", a period disputed by the AP-HP.

Called around midnight under a wrong identity (“

Myatil

” instead of “

Myrtil

”), the patient never answered, then was considered to have left.

She was actually on a stretcher, "

unattended

" between 1 a.m. and 6 a.m., when she was found dead.

Micheline Myrtil has never seen a doctor.

A first autopsy report had established that the patient had died "

of acute respiratory failure secondary to pulmonary edema

".

During the judicial inquiry, the practitioners of the hospital collectively questioned a lack of staff and means, denounced for a long time.

In a hearing, the emergency doctor who should have treated Micheline Myrtil the night of her death thus pointed to an emergency system overwhelmed by the influx of patients and insufficient means and premises complicating care.

"

I did not even know that this patient existed before learning of her death

", he conceded tragically.

Two HRDs from the hospital assured on the contrary that the staff was sufficient in the emergency room to accommodate the influx of patients, as did the director of legal affairs, during the indictment of the AP-HP.

For the latter, the death of Micheline Myrtil was "

due to a double fault in the registration and identity verification

" of the patient at her reception, a procedure according to her "

extremely strict and marked out

".

The Myrtil family, who had quickly denounced a failing care, said this Thursday, January 4 "

satisfied

" with these requisitions in the face of these "

serious malfunctions affecting the emergency department of this hospital

", according to his lawyer Eddy Arneton.

The family “

remains vigilant

”, “

it firmly expects justice to be done

” because “

we die in hospitals in France

”, he added.

A situation of understaffing regularly denounced

For him, the picture drawn by the prosecution is however incomplete “

since the criminal liability of the senior executives of the AP-HP could also be engaged

”.

If the public prosecutor targets in its requisitions "

the administration of the AP-HP

", which "

has allowed a situation of understaffing to persist for which it had been regularly alerted to the risks

", it nevertheless dismisses the individual criminal responsibility of natural persons, considering the institution solely criminally liable, as a legal person.

After this death, Lariboisière announced increased control measures for patients in the emergency room.

The Regional Health Agency (ARS) had also issued various recommendations, including an increase in staff.

The five main unions of the AP-HP (CGT, Sud, FO, CFDT, CFTC) had deplored "

that it took this tragedy for the management to finally commit to the responses to be provided to the crisis situations suffered and denounced

”.

The case of Micheline Myrtil had more widely fueled the chronic debate on the crisis in the hospital world, even before the earthquake of the health crisis linked to the Covid-19 epidemic or the current saturation.
