The investigation against the former head of the Civil Security for attempted sexual assault finally closed

The investigation for attempted sexual assault opened this summer against the former head of the Civil Security, Alain Thirion, was closed on November 15 for an insufficiently serious offense, the Paris prosecutor's office said on Thursday, confirming a report by franceinfo.

A preliminary investigation had been opened after "a denunciation of sexual assault reproached to Mr. Alain Thirion" and entrusted to the Brigade for the Repression of Crime Against the Person (BRDP), the prosecutor's office said in August.

Alain Thirion was accused of sexually assaulting a woman as he entered her hotel room during the graduation ceremony of the new class at the Aix-en-Provence Fire Brigade School at the end of June, sources close to the case said.

Thirion 'suffers from aggravated myopia'

"It is clear from the proceedings" that Alain Thirion "is (...) suffering from aggravated myopia," the prosecutor's office said. "The statements are consistent on the fact that he did not know which room he had entered, in the middle of the night, when the door to his room had closed behind him when he had tried to go to the bathroom," it said.

"No intention or act constituting a criminal offence" having been established, "the proceedings were therefore closed" on 15 November. For Marie-Alix Canu-Bernard, Alain Thirion's lawyer, "it was obviously an expected decision given the total and manifest absence of an offence."

"But it's hard to really rejoice in the consequences ... both personally and professionally" for Alain Thirion. "All of this raises a number of questions that we will now look at," she added.

Serious professional consequences

Alain Thirion was suspended as a precautionary measure at the beginning of July from his duties as Director General of Civil Security and Crisis Management, which he had assumed in July 2019. He was then terminated from his duties in the Council of Ministers. He was replaced by Julien Marion.

In previous positions, as prefect of Haute-Corse from 2015 to 2017, Alain Thirion had been accused of moral and sexual harassment by the sub-prefect of Calvi at the time, Anne Ballereau.

The judicial investigation opened following his complaint was dismissed in mid-July. The complainant has appealed this decision and the hearing is due to be held soon at the investigating chamber of the Bastia Court of Appeal, according to a source close to the case.
