The police is setting up a special department to be responsible for the enforcement of the Hong Kong version of the National Security Law, and is planning to put it into operation on the first day of the law. The Central Government intends to establish a new law enforcement agency in Hong Kong for the Hong Kong version of the National Security Law, but Li Jiachao declined to disclose more details about how the police cooperate with the Mainland National Security Agency or how the Mainland National Security Agency enforces law in Hong Kong.

Li Jiachao pointed out that the new department will have intelligence gathering and armed forces, as well as training for the long-term development of the department. The new department will learn how to use the Hong Kong version of the National Security Law to enforce the law and collect relevant intelligence and evidence on violations. He also said that the police have begun to examine the resources, manpower and equipment of the new department.

Study the deployment of the five major disciplined forces to the new department

Li Jiachao has strong confidence in the police’s law enforcement capabilities, but national security is relatively complex. He said that now the police are mainly dealing with crimes and cases related to public order. He described the establishment of the new department as a progressive move. The number of departments will increase as needed, and he will study the possibility of deploying manpower from the five disciplined forces to the new department.

Emphasize common law principle of presumption of innocence and right to silence

Li Jiachao believes that mainland institutions will have a wider network to collect intelligence, as well as a higher level of analysis and a higher perspective to observe the overall situation. The Mainland will let the Hong Kong government know the whole situation. As a city, Hong Kong may not be able to know it by its own information. Mainland law enforcement experience may allow the Hong Kong Government to learn from some good methods to deal with the need for international politics to maintain national security. This is already a matter at the national level.

He said that when the Hong Kong version of the National Security Act is implemented in Hong Kong, the police will share the intelligence collected with mainland institutions. He emphasized that Hong Kong’s enforcement of laws is based on common law principles, including the presumption of innocence and the right to remain silent. He also said that Macao’s implementation of the National Security Law in 2018 is a good example for Hong Kong.

On June 3, Lin Zhengyue, Zheng Ruohua, Li Jiachao, Deng Bingqiang and Chen Guoji visited Beijing on the same day to discuss the Hong Kong version of the National Security Law legislation with the central government. The police’s plan to set up a dedicated department was first disclosed after Lin Zheng’s visit to Beijing.

The Standing Committee of the National People's Congress will be held in Beijing next Thursday to Saturday, but the Hong Kong version of the National Security Law is not on the agenda of this meeting. It is expected that another legislature of the National People's Congress will be opened this month to pass legislation.
