The man who had been convicted of covering up the crime of Micaela García, the young woman raped and murdered in April 2017 in the Entre Ríos city of Gualeguay, regained his freedom this Friday after the Entre Ríos Justice accepted
his truck as an alternative to bail
of a million pesos that he had imposed.
It is about
Néstor Pavón
, the one convicted of covering up
Sebastián Wagner
in the femicide of the young woman, who was released on August 24, after three years and four months in preventive detention.
In June of last year, the chambermaids Marcela Badano, Marcela Davite and Hugo Perotti ratified Sebastián Wagner's sentence to life imprisonment for being the author of "the recruitment, sexual abuse and death of Micaela García", but they considered that the sentence to five years for Pavón "it
lacked an adequate foundation
."
"Sufficient answers were not provided regarding the actions of the accused, the evidence was not assessed jointly, and
different or contradictory criteria
were applied
in the evaluation of the evidence,
" they said at the time about the conviction of Pavón.
For the chambermaids,
a new trial
should be
held
in which the evidence against Pavón is specifically analyzed, or at least that which indicates that an accomplice participated in the femicide.
The case would go to the Supreme Court, which will have to decide if it orders a new debate or leaves the sentence signed.
Pavón was released after serving three years and four months in prison, which means two-thirds of his sentence and allows him to access the benefit of conditional freedom.
This
was decided by the Supreme Court of Entre Ríos
, for which "even if the sentence was firm and consented, it would already be temporarily framed for conditional release."
