- The building committee of the Ottenhofen municipal council collectively lowered their thumbs: On Schlehbachweg, a client wants to put a two-meter high wall right next to the street.

"The wall meets the roadside and the exterior mirror too, of course," commented Mayor Nicole Schley (SPD) on the request.

During an on-site visit, it became even more clear when looking at the plan: a greening of this wall is planned and this would protrude into the public street space.

“Of course, that doesn't work at all,” Schley continues, not only having the right, but also the committee behind him.

Her deputy Dieter Effkemann (FWO) reminded the new council members in particular of earlier disputes about such enclosures, where the community even won a lawsuit.

“We have already sued something like that elsewhere.

We must not use two standards, ”warned Effkemann, who received no contradiction.

If all else fails, plans will have to be rescheduled

Even more: the development plan already represents a concession for this landowner in terms of the fencing at this point.

The community is in a certain predicament: The client had made the approval of this wall a condition for the assignment of a strip of land to widen the street.

Such coupling deals are at least legally questionable.

The editors have cases from Wartenberg, for example, where this was immediately rejected.

Without this strip of land, however, the community will have a problem with the development of the new development area, which actually runs over this very narrow street at the said point.

If all else fails, plans will have to be rescheduled.

But the community also has other options, albeit annoying for all sides, which have not yet been discussed publicly since this site inspection.

For the time being, however, the committee worked out a further compromise: The municipality then not only acquires the strip of land for the street, but also the further 50 centimeter strip between the street and the wall, which would free the client from maintaining this area.

This, according to the opinion of the committee, gives the mayor a certain leeway in further talks.
