Pop-up cycle paths in Berlin: AfD applies for immediate dismantling

The dispute over temporary bicycle lanes in Berlin is coming to a head. The AfD wants to oblige red-red-green to dismantle the lines. And the FDP also sees its chance to annoy cyclists a little.

The Alternative für Deutschland (AfD) in the Berlin House of Representatives calls for the immediate clearance of the pop-up cycle paths in the capital.

The parliamentary group's spokesman for transport policy, Frank Scholtysek, is now submitting a corresponding application to the Berlin administrative court, which SPIEGEL has received.

During the Corona restrictions, several districts with the backing of the red-red-green Senate had designated a lane on various main roads as a so-called pop-up path, i.e. a provisional bike lane.

The cost of building it amounted to several hundred thousand euros.

The administration had justified the measure with the fact that larger distances had to be observed in road traffic.

The AfD MP Scholtysek had sued against the Berlin regulation, which also found imitators in other cities - and received justice from the Berlin administrative court on Friday before last.

The judges had decided that Corona did not justify such serious interventions in road traffic.

FDP calls for the removal of protective bollards for cyclists

A spokesman for the Senate Department said on Thursday that the temporary cycle paths would not be dismantled for the time being.

The Berlin Senator for Transport Regine Günther (Greens) announced a complaint against the judgment at the Higher Administrative Court this week.

The legal service of the Bundestag had already confirmed Günther's legal opinion in the summer in a short report.

The OVG complaint should have a suspensive effect.

The AfD's application for enforcement states that the OVG complaint "has no suspensive effect by law".

The MP Scholtysek demands that the Senate should comply with the decision of the administrative court "to remove traffic signs and lane markings".

It is "quite remarkable in a constitutional state" that the red-red-green Senate "despite an express order from the court does not want to obey".

Even before the pandemic, the Berlin Senate tried to make it easier to set up temporary bicycle lanes by changing the road traffic regulations.

However, a corresponding initiative failed in the Federal Council in February.

The FDP also sees itself reinforced in the fight against structurally delimited cycle paths, as the "Tagesspiegel" reports.

In the Berlin district of Steglitz-Zehlendorf, the liberals are calling for the district office to demolish bollards.

These protect cyclists on a route that was set up before the corona crisis - and are a thorn in the side of some motorists.
