The Constitutional Council will set up a database to bring up all the information that exists on all the QPCs and why some have not prospered.

Removing this 'blind spot' is decisive if we wish to give even more scope to the QPC which is already a real success after ten years of existence,

This new census tool, created in close collaboration with the Ministry of Justice, the Council of State and the Court of Cassation, will make it possible to know all the questions raised by citizens before all the courts of France, including those which were not transmitted, specified the Constitutional Council.

To date, only those coming before the Council of State, the Court of Cassation and the Constitutional Council are easily identifiable.

To further advance the QPC, all of the “

citizen questions

” asked can now be known thanks to this new database which will be deployed on the website of the Constitutional Council.

The QPC is the recognized right of anyone who is a party to a lawsuit or proceeding to argue that a legislative provision infringes the rights and freedoms guaranteed by the Constitution.

If the conditions for admissibility of the question are met, it is up to the Constitutional Council to rule and, if necessary, to repeal the legislative provision.
