After the Defender of Rights, it is the Cnil's turn to express reservations on the bill relating to the extension of the health pass.

The president of the National Commission for Informatics and Freedoms (Cnil), Marie-Laure Denis, was heard in the Senate today to give the institution's opinion on the measures announced by the government last week.

She had already warned about the implementation of the health pass in May.

By being made compulsory for places of leisure, bars or restaurants, the extension of the health pass "includes an ethical dimension" according to the Cnil.

"In principle, there should not be any control of the state of health at the entrance of places of collective life" is it written in the opinion delivered Wednesday.

The Commission warns of the risks of “trivializing such devices that threaten privacy”.

"Avoid the generalization of identity checks"

Like the Defender of Rights on Tuesday, the CNIL is questioning the proportionality of the new measures to the gravity of the situation. She therefore calls on parliament to better distinguish the places concerned by the application of the health pass: "the risks are not the same between, for example, the rooms and the terraces of restaurants" she explains. Same doubts also on the obligation of the health pass for minors, less affected by the serious forms of Covid-19.

The CNIL also asks for better precision in the law of the methods of checks: "It is advisable to avoid the generalization of extensive identity checks in all places where the health pass is instituted".

Jean Castex also declared in the 1 p.m. newspaper on Wednesday that restaurant owners would not have to verify the identity of their customers when checking the health pass.

This exception will not apply for the moment to other places of recreation.

On the side of the security of medical data, another point to watch for Marie-Laure Denis: it is necessary to "avoid the constitution of file containing all the vaccination certificates of the employees".

On several subjects therefore, the CNIL calls on Parliament to specify the modalities of application of the health pass, in order to avoid abuses.
