Experts from the consumer rights portal Conny Legal warn against agreeing to rent increases without checking them
The lawyer and managing director of the consumer rights portal Conny Legal
Dr.
Daniel Halmer
expressly warns against agreeing to a rent increase without first having it checked by an expert.
Payment of the new rent is also considered consent:
“Once tenants have agreed to an increase in their rent, it is difficult to undo an illegal increase.
Tenants typically have at least two months after receiving the letter to have the increase reviewed before the landlord can file an enforcement action.”

These reasons can justify a rent reduction
The basic prerequisite for being able to enforce a rent reduction is first of all that the
tenant did not cause the defect in the rented property himself
.
In addition, according to Section 536 Paragraph 1 of the German Civil Code, the reason must not have been known when the rental agreement was concluded.
Mold
humidity
Heating failure or heating does not heat sufficiently
Insufficient cold or hot water supply
noise
vermin
Wrong living space in the rental agreement
water damage
Broken elevator
Disruptions from construction sites
lack of ventilation / window in the bathroom
Front door not lockable
Drafts/leaky doors or windows
missing smoke detectors
Damage to the building fabric
