The Supreme Court today unanimously ruled: Access to a surrogacy arrangement should be allowed for same-sex couples and single male genetic offspring.

The Supreme Court has ruled that the surrogacy arrangement provided for in the Embryo Carriage Act and the Egg Donation Law, which prevents single men and same-sex couples from using surrogacy, disproportionately infringes the right to equality and parenthood of these groups, and is unconstitutional.

"The sweeping exclusion of the gay men's group from the primacy of the surrogacy is seen as a 'suspicious' discrimination, which attributes inferior status to this group, thereby inculcating further, severe and degrading human dignity on the basis of gender or sexual orientation," the Supreme Court ruled.

The court added that ways can be found to protect the dignity and well-being of surrogate women in a way that does not lead to the discrimination of single men and same-sex couples. The judges ruled that the law's violation of the right to parenthood and the right to equality is significant and greatly damaging.
