Fire truck becomes the key at the scene

When the judge ruled, he pointed out that the footage from the defense showed that there was a fire engine at the scene, and the fire engine was placed in the middle of the road, and it should not be seen that it did not exist. A police officer witness said that there was no such thing, and the key link of the police officer's testimony was undermined, that is, their claim that the line of sight was not obstructed during the period from the defendant's arrest of the brick to the arrest of him.

The judge further stated that the defendant was subdued outside the Kyocera Middle School at that time. The police investigating the case knew that there was CCTV outside the school door, but did not ask the school for CCTV footage. He also stated in his investigation report that no CCTV footage was found, The CCTV footage is closely related evidence, and the police practice made him feel puzzled. The judge added that when the defendant was uniformed, the fire truck was still on the scene, while other police officers still had to bypass the fire truck.

Based on the evidence presented to the court, the judge found that there was indeed a fire truck on the scene. (Screenshot of the defense Chengtang fragment)

The defendant, Lin Zihao (age 20), was accused of participating in a riot along with other people on Dongtou Village Road in Wong Tai Sin on October 1 last year. Lin said after the crime, "Thank you all, and thank you all for seeing me along the way, everyone." For the person who became the first person in this campaign to commit crimes of riots, he bluntly said: "Nothing has been done before."

The police witnessed the defendant stepping out of the parachute and throwing bricks

According to the control plan, more than 100 people gathered at the scene on the day of the incident. The gathered people all wore gas masks, helmets, long umbrellas, wooden sticks, iron passes, and were wearing dark shirts and trousers. The crowd blocked the road with obstacles, and smuggled debris and bricks to the police line of defense. Police witness Yang Yunqiu said he witnessed the defendant stepping out of the umbrella formation and throwing bricks at the police. The defendant had long hair, no helmet and black shirt pants.

Yang admitted that the defendant was injured after being subdued, including abrasions on his head, temple and right elbow. The defense also submitted the defendant's doctor's report. The doctor found that the defendant had a laceration on the top of the head, a tender neck, and bruises on his right hand, left arm, and knees.

The defense questioned the police pulling the wrong person

The defense pointed directly at the scene before the police arrested a fire engine. The police officer Yang Yunqiu, who was arrested, bypassed the fire engine and "pulled when he saw the black shirt", pointing to the police "pulling the wrong person." The defense stated in the closing statement that the prosecution only relied on police officers to observe for a short period of time, but the video and other substantive evidence questioned that Yang Ruo really saw the defendant throwing bricks.

The officer pointed out that the police officer did not tell the reason for the defendant's injury

The judge also mentioned the injury on the defendant’s head during the ruling, saying that the two police officers failed to provide a reasonable explanation when they gave evidence, that they did not tell the truth and affected their credibility; It should fix its eyes on the front, not fixate on one person, and the police should hunt down the person who runs the slowest, not the person who does not wear a helmet.

The judge questioned the statements of the two police officers and witnesses. They could not exclude the police officers from giving evidence when they gave testimony, excluding the testimony of the two. It was just passing by the scene, or related to the earlier incident at Dongtou Village Road. Because the prosecution failed to prove the charge without reasonable doubt, the defendant was found not guilty.
