On the night when the "Prohibition of Face Masking Law" came into effect in October last year, people gathered in many districts. A mainland tourist and a Hong Kong man who was mistaken for a policeman were accused of taking photos and moving roadblocks and were "privileged."

2 men and 1 woman pleaded guilty to participating in the assault and pleaded guilty to wounding others. They were sentenced in the District Court today (28th). Judge Guo Qi'an pointedly pointed out that the lynching behavior was unacceptable. The three defendants were originally well-behaved, but the behavior in this case was different. The villain attacked innocent citizens and sentenced 3 people to 15 to 48 months in prison.

Three defendants: Luo Weihua (57 years old, cleaner), Huang Qiting (23 years old, saleswoman), Egyptian Soliman Ahmed Fawzi Elsayed (36 years old, construction worker).

Luo pleaded guilty to two counts of intentionally causing serious bodily harm to others, and the other two pleaded guilty to one count of inflicting serious bodily harm to others with a lighter criminal liability.

The three people were accused of hurting a male mainland tourist X with others on Nathan Road near Argyle Street in Mong Kok on October 5 last year: Luo Yuan hurt a 45-year-old local man Y with others in the early hours of the next morning.

The official instructed the threat to have become violent and out of control

Judge Guo Qi'an pointed out when sentencing that although the case involves political background, the court will only resolve legal disputes, not political disputes.

At the time of the incident, the demonstrators had become violent and out of control. They blocked roads and blocked traffic in the busiest part of Kowloon. Mainlanders or policemen would be attacked even if they just passed by.

Neither victim attacked others

Guo Guan pointed out that although the three defendants explained that the victim wanted to attack others and therefore committed the crime, the footage involved did not show that the victim attacked or threatened to attack others. Even though X was holding a rectangular object at the time, he did not use it as a defense when he was attacked.

Luo Shi attacked for 4 years because he hated the police and mainlanders

Guo Guan believes that Luo Shi’s attack was only out of hatred for mainlanders and the police, and he does not accept the idea that he thought he intended to attack others, and the law does not allow others to retaliate. Taking into account Luo’s good character in the past, the weapons used and the past Make compensation to the victim and sentence him to 4 years in prison.

The other two defendants also acted like villains.

As for the other two defendants, Guo Guan believed that their behavior was unacceptable for whatever reason, and they could not lynch or retaliate because the other party had different backgrounds or opinions.

Although the two were not the main assailants and had good characters in the past, their behavior in this case is no different from the villain’s attack on innocent citizens. Taking into account their plea and compensation, they were sentenced to 15 months in prison each.

The victim X was shot and beaten on the spot

According to the case, the 29-year-old X came to Hong Kong for travel the day before the incident. At nearly midnight that day, he was recognized as coming from the Mainland when he returned to the hotel. He was then intercepted and beaten, including three defendants.

During this period, someone claimed that X was on the scene to shoot and hold a brick.

X was beaten until he bleeds heavily. After being sent to the hospital, he was diagnosed with a lacerated scalp. There were also multiple abrasions and bruises on his body. He recovered afterwards.

The victim Y was mistaken for a policeman by the man in black

Another 45-year-old male victim, Y, took a taxi home after dinner with a friend, but got out of the car when he encountered a roadblock.

When he returned home on foot, he removed the barricades that blocked him. The people in black believed that he was a police officer. He was then punched and kicked. The unmasked Luo was photographed and shot Y twice with a club.

Y was diagnosed with a laceration on the top of his head after he was sent to hospital due to heavy bleeding, and his right hand mobility was blocked.

The two victims have no permanent injuries and have recovered.

When the defense interceded, he pointed out that Luo Yin X held a brick and committed the crime because he feared that the other party would harm young people; and because he heard that Y wanted to use bamboo sticks to attack the demonstrators, he swung his stick at Y.

Huang Yin saw the victim X holding a brick that night, so she followed the other party. She had no intention of participating in the attack, but X reached out and pushed when he fell to her; the Egyptian defendant said he joined the attack out of curiosity.
