Defendant Liang Jingying, 67 years old this year, earlier pleaded guilty to one count of disclosing the identity of the investigator under the ICAC and the details of the investigation, in violation of Article 30(1)(b) of the Prevention of Bribery Ordinance.
The case revealed that an ICAC investigator called the defendant on May 15, 2020, inviting him to be interviewed to provide information on the investigation of a corruption complaint.
The defendant accepted the interview 3 days later.
On both occasions, the investigator reminded the defendant about the provisions of Article 30 of the Prevention of Bribery Ordinance, which stipulates that the identity of the person under investigation by the ICAC and the details of the investigation shall not be disclosed to others.
The defendant replied on both occasions that he understood the content.
On June 29, 2020, the defendant told two senior sports officers of the Executive Committee of the Basketball Association that he had been interviewed by the ICAC on a corruption complaint.
The defendant also told the two that he guessed that the ICAC would contact them later, so he wanted to tell them about the investigation in advance.
According to the facts of the case, the defendant understood that he was responsible for keeping the contents of the investigation confidential, but still disclosed the identity of the person under investigation by the ICAC and the details of the investigation to the above two persons.
