Fong Chung-yin, the former president of the HKBU University Union, bought 10 laser pens at Apliu Street in Sham Shui Po the year before.
Fang was thus charged with possession of an offensive weapon, resisting a police officer and obstructing justice. The defense argued that the laser pen had no battery, and that the police officer was wearing civilian clothes at the time, and Fang had avoided it as a reasonable move.
A judge today (8th) ruled that Fang was guilty of possessing an offensive weapon, but was convicted of resisting a police officer and obstructing justice.
Defendant Fong Chung-yin (23 years old, student) denied that on August 6, 2019, in the vicinity of Apliu Street and Guilin Street in Sham Shui Po, he was armed with offensive weapons, namely 10 devices capable of emitting laser beams, and was outside the convenience store on Guilin Street. Fang also denies that he committed obstruction of justice on that day by resetting the mobile phone before the police seized it as evidence.

Off-duty police shoppers hear conversations from neighbors

When he saw Fang and returned to the shop, he informed his boss. When the boss tried to stop Fang, Fang ran away, but was still stopped. Fang continued to struggle after that.
Fang later expressed discomfort and was sent to the hospital. After the police seized his phone, they found that his phone had been reset on the same day.
There is no battery in the laser pointer
Fang did not appear in court to defend himself. His lawyer pointed out that there was no riot in Sham Shui Po that day. Although some protesters irradiated the police with laser pens during the riot, it did not mean that Fang would do so, and Fang knew that the laser pens had no batteries. If you want to use it as an offensive weapon, why not buy a battery?
It is reasonable to suddenly be put on the arm and dodged away
The lawyer also pointed out that the police officer who intercepted Fang was wearing civilian clothes. He suddenly touched Fang’s shoulder, and Fang’s “step back two steps” was a reasonable move. The difference is only for the opponent.
The lawyer believes that the prosecution failed to prove that the information lost by Fang’s phone was related to the charge of possession of an offensive weapon, and the ambulancemen in the ambulance did not hear that the police reminded Fang that the phone would be seized as evidence.
