Badeweiher in Langenpreising and Berglern: A forest of signs intended to provide clarity

The municipality of Berglern, like the neighboring municipality of Langenpreising, must have a safety concept drawn up for its bathing pond.

The legal protection for bathing fun was now a topic in both council meetings.

Berglern/Langenpreising – Berglern costs €10,000 for legal advice on the package of measures.

However, this not only includes the actual security concept, but also the statutes for the use of these leisure facilities and the lease agreement with the owners, which is due to expire in the next few weeks.

Lawyer Gregor Schneider informed the municipal council in a humorous presentation about everything that needs to be done and observed.

He also reported in detail on the background: After three children drowned in a village pond in Hesse, the mayor was sentenced to a fine for negligent homicide by omission.

At that time, as a first reaction to the judgment of the Federal Court of Justice, jetties were closed and bathing islands were pulled ashore.

The examples from the northern district: Notzinger Weiher and Thenner See.

Berglern only has a lease agreement with the Gutbrod family that owns a third of the area for the pond.

The rest is leased to the fishermen.

Consequently, bathing should only be done in the third of the pond that belongs to the community.

However, deviations caused by bathers cannot be prevented technically.

The lawyer strongly advised against demarcating the bathing area.

The fatal accident happened exactly on one of these a few years ago.

The lawyer described the pond as a largely natural body of water where there were no typical bathing facilities.

This applies, for example, to all forms of sanitary facilities.

But that also applies, in contrast to Langenpreising, to the complete lack of lifeguard supervision.

The community must point out that they do not exist.

It is already possible to put up information boards.

That's why the municipality is technically relatively easy.

The lawyer recommended, in addition to a general warning sign, a warning sign for non-swimmers regarding water depth, one for sudden changes in depth, one for risk of injury when jumping in and one for shallow water depth in dry summer.

The attorney also advised a winter sign warning of low ice density.

Berglern's municipal council unanimously commissioned Mayor Anton Scherer to draw up the statutes and the lease agreement and to implement the security concept.

After detailed consultation, however, one thing is already ruled out: Open fire of any kind is prohibited, the existing concrete rings intended for this purpose are probably dismantled.

The owner family, who held out the prospect of a lease for the next ten years, made it clear that they saw an increased risk of fire in midsummer and therefore rejected open fires, for example for barbecuing.

For the lawyer and the mayor, the issue was immediately settled.

Meanwhile, Langenpreising is issuing house rules for its bathing pond, combined with a safety concept.

Mayor Josef Straßer couldn't help but make a witty remark: "What we don't need is an indication of the risk of explosion." This is due to the fact that the Baisch-Weiher, unlike the Thenner See near Wartenberg, was only dug after the war.

That is why military contamination can be ruled out there.

A separate board at the bathing pond will be dedicated to the numerous danger signs in Langenpreising.

The house rules otherwise contain the details tailored to the location, such as a protected zone in the water where swimming is not allowed, a fishing zone and an indication of the surrounding area, which is partly a nature reserve.

Diving with compressed air tanks is prohibited, as is the operation of motor boats.

Of course, these bans do not apply to rescue services or the police.

By the way, friends of nude bathing have to look for other bathing waters: You are only allowed to stay in normal clothing or in the usual swimwear.

In addition, there is a general ban on photography.

The use of photo drones is prohibited by a special paragraph.

Staying between 10 p.m. and 6 a.m. is strictly prohibited.
