A Munich landlord wanted to make his tenants happy with affordable prices.

The numbers are a thorn in the side of the tax office.

Now he is supposed to pay back taxes of around 40,000 euros.

Thaddäus Spegel (65) still does the accounts manually.

The man from Oberhaching knows exactly who he raised the rent and when.

"I have an eye on my documents," he says, knowing that this will soon be important.

Because the tax office has imposed a tax audit on Spegel.

Result: The landlord should pay more than 40,000 euros.

"That's absurd," says Spegel.

He has more than 100 apartments in Munich - and asks for prices that are below the rent index.

“Some tenants have lived in my apartments for 30 or 50 years.

It's important to me that they feel comfortable and treat my property well," says Spegel.

Prices between 12.50 euros and 13.50 euros per square meter are usual for him.

“They partially completely prepared the apartments, installed floors and kitchens.

That's why I ask even less of them," says Spegel.

In one case, for example, the price is 8.80 euros: the tenant on Hansastrasse pays 540 euros for 61.28 square meters.

"But the tax office wants me to charge 1236.17 euros." So 20.17 euros per square meter.

"But the calculation makes no sense from my point of view."

Because: Legally, this is about the assessment of a pecuniary advantage for the tenant, which should also be taxed.

"An absurd regulation that must be abolished," says Rudolf Stürzer, chairman of the owners' initiative Haus und Grund Munich.

"The state must be happy that an employer provides affordable housing for its employees," says the lawyer and demands: "You shouldn't fleece a landlord in addition."

Volker Rastätter from the tenants' association sees it similarly: "It is unacceptable that fair landlords are also being punished." Landlords have to pay tax on their income.

Here, however, the expenses are still deducted as income-related expenses.

The problem: "If a landlord demands less than half of the rent according to the rent index, the tax office only partially recognizes his income-related expenses, for example for maintenance, repairs and depreciation," says Stürzer.

This often happens to private landlords with old, long-term tenancies.

Like Thaddäus Spegel, who is said to shell out more than 40,000 euros.

In cases like these, according to the tenants' association, the only option is to take legal action.
