The potential candidates for the position of State Attorney - and the political obstacle that awaits them

The State Attorney's Search Committee has officially begun accepting nominations.

Deputy State Attorney Lemberger and Haifa District Attorney Iceman have been named leaders, but it is now estimated that the plaintiff in Netanyahu Ben-Ari's case will also join the race.

Whoever is elected will need government approval - a hurdle that currently seems insurmountable

The selection committee for the position of State Attorney began its work this week, and issued a call for applications for the position, which will run until November 8.

In recent days, the names of Deputy State Attorney

Shlomo (Momi) Lemberger

and Haifa District Attorney (Criminal)

Amit Eisman

have been mentioned

as the two leading candidates.

It is now estimated that the Deputy State Attorney and the prosecutor in Netanyahu's cases,

Liat Ben-Ari

, will also submit her candidacy.

Almost a year ago, when former State Attorney Shai Nitzan ended his term, Amir Ohana sat in the office of the Minister of Justice - which made Ben-Ari's candidacy unrealistic.

This was also the case in the bid for the position of Deputy State Attorney, but now the circumstances have changed, and it is estimated that Ben-Ari is expected to run.

Ben-Ari currently serves as Deputy State Attorney for Economic Affairs, but is known to the public mainly as a prosecutor in Prime Minister Benjamin Netanyahu's cases.

She was considered the one who led the offensive line in these cases, and believed that three indictments should be filed against the prime minister for bribery, as well as blaming his wife Sarah Netanyahu and businessman Arnon Milchen.

Prior to that, the plaintiff was also in the Holyland case against former Prime Minister Ehud Olmert.

Due to her role as a prosecutor in the prime minister's files, Ben-Ari suffered personal attacks, including from Netanyahu himself.

In recent months, for example, right-wing activists have claimed that her son assaulted police officers during a demonstration, and that she used her authority to stop the proceedings against him - a move completely denied by her and the Ministry of Justice.

Attorney General Avichai Mandelblit even asked the court for an order to prevent threatening harassment, in order to force one of the right-wing activists to stop spreading the claim on social media.

Another affair that has accompanied Ben-Ari recently is the construction offense that was discovered in her home in Rosh HaAyin.

In July, it was reported that she and her husband were suspected of splitting a villa they had purchased in Rosh HaAyin, and applied for a permit only after an inspector located the construction deviation in the area.

The affair has been extensively covered in media affiliated with the right, such as Channel 20, and its handling by the municipal prosecution in Rosh HaAyin has not yet ended.

Ben-Ari's candidacy was considered unrealistic during his tenure as Minister of Justice.

In addition to the media treatment, three complaints were submitted to the Commissioner for the Review of the Prosecution, retired Judge David Rosen, regarding the conduct of Ben-Ari and the State Attorney's Office in the case.

Ben-Ari told the commissioner that "the complaints are part of a large-scale, long-term organization that aims to loosen its grip on her role as a lawyer, given her role as head of the prosecution team in the criminal case filed against the prime minister and other defendants, and instill fear in attorneys."

To the substance of the matter, Ben-Ari replied that the handling of the purchase of the house was done by her spouse, and that the anomalies made are at the lowest threshold, and the policy of the local committee in Rosh HaAyin, which was officially published, supports splits as done in property and approves such requests.

The complaints were all dismissed - partly on the merits and partly because Rosen found he had no authority to investigate them.

Acting as Acting State Attorney.

Lemberger (Photo: Ministry of Justice spokeswoman)

Another leading candidate is Lemberger, the Deputy State Attorney for Criminal Affairs, who previously served as the Southern District Attorney and the Tel Aviv District Attorney.

Lemberger was the preferred candidate Mandelblitt as Acting State Prosecutor, and at one point he even put it to the Minister Ohana as the only candidate and argued that the choice "versus" the minister is not reasonable nor will the Supreme Court. Ohana rather choose another candidate.

Since May No Officially acting as State Attorney, but according to prosecutors, the person actually filling the vacuum is Lemberger. For example, he issues guidelines that are usually issued by the State Attorney, with the proviso that they will be re-examined when he is a permanent attorney. Himself, at least in the criminal context, as an actual state attorney. "

A third possible candidate from the State Attorney's Office is Eisman, currently the Haifa District Attorney (Criminal), who previously served for about two years in the actual appointment as Deputy State Attorney for special positions.

Iceman is considered a highly esteemed attorney.

"He is an honest man," a prosecutor said of him.

"For example, there is no other district attorney like him who finds it important to investigate faults, learn from them, and not whitewash."

What may make it difficult for Iceman's appointment is an affair from a few years ago, in which he was questioned on suspicion of sexual harassment for inappropriate remarks.

In the end, Eisman was sentenced to a warning by the then director general of the Ministry of Justice, Amy Palmor.

In discussions on the prime minister's files, Eisman was the one who proposed accusing Netanyahu of fraud and breach of trust in the 2000 case. Ben Ari believed the evidence provided a reasonable chance of convicting the prime minister and Yedioth Ahronoth publisher Noni Mozes in bribery.

On the other hand, Deputy Attorney General Raz Nizri believed that there was not enough evidence to prosecute any of them. The Haifa prosecutor thought that the evidence indicated an offense of fraud and breach of trust by Netanyahu, and a bribe offer by Mozes. Although State Attorney Nitzan sided with Ben-Ari Q decided exactly as Iceman suggested.

Politics is pushing the appointment away

There is also the possibility that the committee will select a candidate who comes from outside the State Attorney's Office, or perhaps even from outside the Ministry of Justice.

The threshold conditions allow this, but it is not clear at the moment how many jumps there are on the job.

One name mentioned is the national public defender, Adv.

Yoav Sapir

, but at the moment it seems that the chances of him deciding to apply are nil. Another candidate whose name has also been mentioned in the past is the Chief Military Advocate, Major General

Sharon Afek

, but he is not at all sure he is interested in the job. .

finally, if the search committee completes its work and recommend a candidate, chosen by Minister of Justice, the chance to be appointed state prosecutor looks now very low just for political reasons. the appointment must obtain the approval of the entire government, and now blue and white and the Likud did not agree at all on Appointments and Upload them for approval.
