Verdict in Upper Bavaria: neighbor of a cheese shop must not hang up stinky signs

Even lovers of cheese have to admit: sometimes it stinks enormously. The neighbor of a cheese shop in Bavaria is not allowed to protest against the smell with stickers - despite freedom of expression.


For some enjoyment, for others annoyance: In the dispute over supposedly unpleasant smells from a cheese shop in Upper Bavaria, a court in Munich has passed a judgment. The district court of Munich II partly agreed with the owner of the Tölz casladen in Bad Heilbrunn and partly with the neighbor.

The proceedings were about whether residents of the house can speak publicly about the smell and express their anger with stickers on the cheese shop. The neighbor had put up notes showing an unpleasant nose.

The court now decided that the neighbor should no longer apply the stickers. But she can go on to say "that there is an odor nuisance and that she finds it smelly," said a court spokeswoman. "It is an expression of opinion."

The judgment is not yet final, legal remedies are possible. The so-called "cheese feud" has dragged on for years and has also occupied other dishes.
