(ANSA) - MILAN, JAN 9 - The Lazio Regional Administrative Court rejected the urgency of a Vivendi appeal on the 2017 Agcom provision based on the 'Gasparri law' which intimates the French to choose between the participation in Tim or in Mediaset and has fixed a joint discussion of the affair January 15.
The Agcom provision, of which the French asked for suspension of its effectiveness in view of tomorrow's Mediaset assembly, is the foundation on which Biscione excludes the trust of the French Simon from the vote, which holds almost 20% of the Italian television group.
Vivendi's appeal, for which the TAR did not find sufficient gravity and urgency reasons to make a 'monochromatic' decision and therefore refer it back to the legal treatment, was based on the Advocate General's motivations at the Court of Justice EU - whose decision has not yet been taken - which in December had criticized parts of the Unique Text of the radio and television system underlying the Agcom provision.
