Israel's Supreme Court will hear a petition Wednesday asking the court to order the state to allow gay couples to have children. The panel consisted of Judges Uzi Fogelman, Alex Stein and Judge Gila Kanfi-Steinitz. The discussion will be broadcast live on the Israel Hayom website.
The Adoption of Children Law states that "there is no adoption except by a man and his wife together." Attorney General Gali Baharav Miara wrote that "there is indeed a linguistic difficulty in the interpretation that seeks to apply section 3 of the Adoption Law to same-sex couples." At the same time, she wrote that "according to the Attorney General's position, a closer examination shows that the language of the law can carry a broader interpretation that allows the adoption of common-law couples, as well as same-sex couples." In other words, the counselor says that the court can interpret the law in a way that gay couples can adopt.

Welfare Minister Yaakov Margi of Shas responded earlier this week to the same petition and wrote that he opposes the possibility of adopting children by LGBT couples. Minister Margi said, "I oppose any interpretation that allows giving children up for adoption to same-sex couples, for reasons of the best interests of the child."
