A trademark application for the phrase "From the river to the sea Palestine will be free" was filed by an American-Jewish lawyer named Joel Ackerman, and if he receives the rights he can sue organizations that use the slogan. The chances of him getting it are not high.
Another company, From the river to the sea shop, asked for the rights to "From the river to the sea", without further trial and he already uses it in the products he sells. Once there is a commercial use, the chances that he will succeed in obtaining the rights to the trial are greater.
Attorney Joel Ackerman's trademark application,
"In order for a trademark to be accepted for registration, it is necessary to prove actual use of the trademark – whether as a logo or as a slogan on shirts, for example," explains attorney Rachel Silberfarb Schreiber, "in the case of the full trial – there is no indication of actual use, and therefore the chances that such a popular trial will pass serious examination are almost nil.
"On the other hand, the second application for the abbreviated trial (which does not include Palestine) was accompanied by proof of the use of the mark both as a logo and on products sold by the applicant on his website, which will increase the chances of passing a substantive examination and perhaps – depending on the amount of proof required and provided – will be accepted for registration."
